    He had to be evaluated and was, and likely was diagnosed with a psychotic disorder. These more than any other dx will sometimes get an incompetence judgment.

    Schizophrenic or schizoaffective folks might be "aware" of what they're doing, even alert and oriented to person, place, etc., but the assessment of their thought formulation, processes, content, etc. sometimes demonstrate an inability to understand rationally what they're doing or why.

    This is clearly a waste of time and money. There are way too many credible witnesses of the incident. They may even have video also? Crazy or not, it's the nature of his act. You can never, ever trust someone who does something like this. It's time take him out and move on with more important things. We will accomplish nothing be taking our sweet time with this, except put off other responsibilities that may need the attention.

    Perhaps they could fly a new law through that would apply to ongoing and future cases that have so much overwhelming evidence such as this one. It would force an immediate trial leading to guilt and punishment of death within a 24 hr period. It should only be conducted in special circumstances like ones as self-obvious as these.

    He can't defend himself at trial. Holding a trial at this point would be a mockery. In the meantime, he will be institutionalized for the safety of the community.

    Honestly, I don't understand what everyone is so upset about. It's not like he's getting away with anything.

    True, he's not walking away free. He'll undergo treatment with drugs and possibly electro-shock therapy for four months and then be evaluated again. It's our right to be actively involved in our own defense. He doesn't even trust his own defense team, then he's incapable of participating.

    The judge said the experts who examined Loughner both concluded that he was schizophrenic suffering from paranoia and delusions. His mental illness is such that he does not trust his own lawyers and cannot at this point assist in his own defense.

    As long as he's locked up, he's paying for his crime. They think he can be "restored to competency". Then the trial will proceed.

    I don't disagree, but we're talking about violating the most basic foundation of our criminal justice system. If he can't participate in his own defense, putting him on trial is no different than a summary execution.

    Insane criminals of this caliper are NOT kept in the best of conditions.

    Honestly - if he were aware of **** - he'd WANT to be just a regular prisoner and NOT spending his days pilled up and roped in a nut house. There will be no right to demand tv and pb and j where he's going

    I most certainly wouldn't want to end up where he's going - those found criminally insane have limited freedom and rights even more so than the other mass-murderers and killers in the system.

    I remember a visiting law professor argue that executing the really whackos made more sense than say a hit man who is completely rational (killing for money). the latter has talent and can be useful to the government. an insane barking at the moon loon is past be salvaged
