The Arizona Legislature unanimously has passed a bill meant to stop church from protesting at funerals of Tucson shooting victims.

The vote was 29-0 in the state Senate and 58-0 in the state House. A spokesman for Gov. Jan Brewer earlier told CNN that she was prepared to sign the bill.


Tucson, Arizona (CNN) -- The Arizona legislature is expected to pass legislation Tuesday targeting a Kansas church whose members have announced they plan to picket the funerals of the victims of Saturday's shootings in Tucson.

The proposed legislation would make it a misdemeanor to protest within 300 feet of a funeral from one hour before until one hour after a funeral, a spokesman for the state House said.

The action, according to House spokesman Daniel Scarpinato, is in direct response to the Westboro Baptist Church's announcement that it will picket the funeral of Christina Green, the 9-year-old who was among six people killed during Saturday's attempted assassination of U.S. Rep. Gabrielle Giffords, D-Arizona.

The controversial church, based in Topeka, has made its name by staging protests at funerals of people who died of AIDS, gay people, soldiers and even Coretta Scott King.

Yeah, can't say I have a problem with this. Free speech has always had limits, and this limitation to me carries little dangerous consequences.
 
Even if overturned, the funeral will be over long before the appeals process.

Although I'm sure the Phelps clan will just stand 301 feet away.
 
Why hasn't other states tried this tactic. You can place a lot of people in a 300 foot zone pushing Freddy pretty much out of anyone's view.

No one has came up with a better solution yet. No one.

You and I agree on most things, but I will disagree with you on this if you are saying Az is wrong in the law regrarding prostesting at funerals. I for one (living in Az) think it is ok to limit how close protesters can be to a funeral. I do not support the actions of the members of that Church. I do support that they have the right to say what they want. It just basically saying you can't get in my face to spout off. How is that stopping their "hate speech". We have limits on how close people can campaign at polling places. Why not limits to how close you can get to a grieving family at a funeral?

This is a blatant violation of the constitution and they know it but yet they enacted it anyways because they know it will be some time before a judge will overturn it. How is this any better than libs ****tig on the constitution in DC,Chicago or some other place to ban or severely restrict firearms because they know it will be some time before it gets overturned. Not only is this a blatant violation of the constitution but a blatant misuse of the courts.

This bill says when and how far they can protest based on the hate Speech of Phelps. This is simply nothing more than a baby step towards banning other speech deemed hateful.

JR. I see you point and it is a fine line. What I am hoping will happen is the protesters will be met by the public and forced back away from the funeral. IMO, the public will have as much right to that sidewalk as the protesters.

I think I'm missing a bit of cultural knowledge here, being English. I've heard of this church, and their picketing of AIDS victims and soldiers funerals, but, what's the connexion to the little girl?

That being said, I'm going to side with JR on this on principle. I DETEST the Phelps clan of clowns and morons. However, some lines once crossed may become easier to cross again. The action was one of emotion, by the State Reps, and while it was an act of good intention... the path to hell is laid with them. (good intentions)
 
I think it's pretty easy to side with these ****tards when it isn't your child's funeral that they are protesting. I can also see it as a safety issue. Emotions run high at funerals. I can easily see these protests eventually resulting in the death of one or more of these idiots. I could defend free speech if I thought for a second that these people weren't vile hypocrites who do this for shock value to gain media attention. They always make announcements that they are going to protest high profile funerals to garner media attention. They absolutely love to be hated. I'm all for this legislation for a variety of reasons. I don't see it as the slippery slope that others do. It has nothing to do with just banning hate speech. These morons have plenty of time to spew their hatred. I don't see any reason to allow them to do it at people's funerals, which are meant to honor a person and put them to rest. It has nothing to do with being a lib, and frankly I'm getting sick of the blatant partisan hackery being thrown into every single ****ing discussion here. Don't you people get enough of that bull**** rhetoric with the zillions of other political issues that come through here?

It is a frickin funeral. It isn't a county fair. They can go park their arses 300 feet away and call the little girl a slut as much as they want to.

WTF Did a 9 year old do to deserve such a ****ed up response from that ****ed up so called church? You know, I'm all for freedom of speech, press, and religion but these freaking people need to GO!
