"No refusal" DUI checkpoints could be coming to Tampa

Checking everyone still requires probable cause.

The probable cause is it is New Years and it is a known fact people get drunk. That is why I come off the road on New years. They don't need probable cause to search my big truck they can do any time they want. They do not need probable cause to inspect my truck. You do not care about truckers but you care about drunks. Why am I not surprised.
 
Yet it is ok for truckers and not cars? It is the government and they make the laws. Driving drunk is a crime. If caught admit you are wrong and stop whinning

I agree drunk driving is a crime as it should be but thats not an excuse set up checkpoints and ignore our constitution.

So it is okay for the DOT to pull me over and seach my truck for no reason but if happens to drunks it is wrong. I see the trucker has no rights but drunks do

What about setting up random checkpoints on any givin day like they used to do here in Texas until it was declared unconstitutional. then where is your probable cause? Where should we draw the line? Should we allow police to enter peoples homes and search without probable cause simply because some people conduct illegal activities in thier homes. Why not, you and some others are willing to give up your rights, might as well tear it up. It means nothing to you.

Yep, this is 100% unconstitutional, and I hope someone sues so this can be ruled unconstitutional.

I never said that, you did. What about the majority of those going through sobriety checkpoints that have not been drinking? Dosn't the 4th amendment apply to them?

Also the fact that they have a judge there to write on the spot warrants actually gives such road stops more legitamacy as the judge can see exactly how things are conducted instead of hearing about it second hand from a plaintiff and defendent. However just because the judge is there and able to write on the spot warrants doesn't mean that he is going to.

Not having checkpoints doesn't make driving super dangerous just like not having the TSA pat downs or body scaners DOES NOT mean you will get blon up on your next flight.
 
YUP!!!!! I kept telling people for the last 2 years that MADD is out of control! They are fighting HARD for this. That along with thier sister org the NHTSA. THIS MAKES ME SICK!!!!!!!!!!!!!!!!!! :soap:soap:soap:soap

Republicans, Democrats MUST work together on fighting this!!!!! MADD needs to close its doors. They have done what they were set out to do and finished that about 10 years ago. These SOBs are raping people of their freedoms! To me thats WORSE than drinking and driving! Right now a cop in Illinois can pull over ANYONE and if their get a ticket for DUI...... EVEN IF THEY ARE INNOCENT...... you lose your license for a YEAR!!!!!

Lets burn this strawman here, and now. No one in this thread is defending drunks, they are defending a person's right to not have their property/person searched without cause.

Yeah, I'm aware that this is what the law says and that the courts have upheld it. I just disagree.

Thats funny the cause is that it is new years and people are drinking. Yet no one here will address this has been happening for years to truckers. But we should protect drunks that kill people.
 
Thats fine but I will not be drunk. Because I have a CDL I am DUI at .04%

I bought a bottle of wine today to drink at home with my wife on New Years. I worked over Christmas so I could be home on New Years when all the drunks are out

You don't have to be drunk, that is the point we are making. Let's say for example you leave a biker party, well bikers are known to have a "few" when they party, so by that logic it's reasonable to think you may have been drinking AT the party and you might be under the influence. Therefore you should have to give blood.
 
If all are checked they are not stopping one without cause. If you are sober you will be good.


They don't need any cause to search a big truck so how is checking all cars any different.

That's not even true. They may inspect you truck's operating and safety items. The reasons for them to enter the cab are, Fire extiguisher (usually mounted beside the diver on the floor at the door), flares and triangles (keep them in your side box) and [sic] proper bedding for your sleeper, which you can pull out and show them without them entering you cab.

No I believe the Police are trained by asking a few questions can determine if further testing is needed. If you are sober you will be let to pass with no further tests.

Yet truck driver are subject to searches and random drug and alcohol testing at anytime with no probable cause needed

maybe someone spilled a beer on you and you smell like alcohol. We could give a hundred examples. i shouldn't be forced to give my blood period. Do you have to give your blood as a truck driver?

I do not agree with them either and it sounds like you aren't very fond of them, yet you seem to support the same requirements be forced on others.

You seem to think drunks have more rights when they are an accident waiting to happen. Here is why I don't care. I am not supposed to idle when it is hot or cold. If I left a dog in a truck like that I would go to jail.

Then I am expected to sleep and get well rested even though it is very hot or very cold in my truck. The reefer can run to keep product cold but a driver has no rights and should suffer.

This part leads me to believe it's temporary.

In FACT you are more likely to die of a freakin aspirin overdose than get injured by a DRUNK driver.... much less a buzzed driver. And Im mother ****ing SICK of the government idiots shredding our RIGHTS! Our FREEDOMS! And I dont need an bat-**** crazy org like MADD or any other org to keep doing this to my fellow citizens!

Compare THAT to someone that has had over 2 beers within the hour. You are treated WORSE than a pedophile plus they suck up over $10K of your hard earned money. The penalties vary. For instance with a CDL DUI is .04%

No they can't. You can hand them your log book and no requirement exists (yet) to prove the accuracy of your logs using receipts.

and for drugs and weapons.
Not without a warrant.

Most drivers allow officers to search their truck, because if they don't they know they will be held up until the officer gets a warrant or he decides to quit being a dick. It costs money to an independent trucker or could cost a company driver his job. It's easier just to let them look and be on your way. It's more convenient is completely different than "there is a legal requirement".
