    Federal law has to meet a set of guidelines before it can be enacted over all the states.

    The feds would have a hard time arguing that they have the right to control a substance that is only sold in California, it doesn't meet the qualifications of interstate commerce.
    The state of California would have a hard time convincing a judge that their legalization of the substance isn't affecting other states from people coming in to buy and then crossing back into Oregon, Arizona, Nevada, etc.

    SCOTUS ruled decades ago that State A's commerce always affects State B's commerce even if the commerical goods never cross state lines. I would like to see that ruling overturned during the same procedings that declare the Federal drug laws unconstitutional.

    Prohibition (The Noble Experiment/Volstead Act of 1919) was an early attempt at legislating morality at the Federal level and it failed miserably. Besides, more than half the states at that time already had statutes prohibiting alcohol. The enumeration clause of Article I Section VIII gave no authority to the Federal Government back then to address such an issue, nor should it have any today. It's completely un-Constitutional! All drug laws (as with many others) should belong solely to the individual state's authority.
