The ordinance is in violation of Article I Section X Clause I of the Constitution of the United States. Cities are subordinate to states and lack any sovereignty the states have, thus it is the responsibility of the state government to ensure that city and county governments in their borders adhere to the Constitution of the United States. For reference here is the clause.

No State shall enter into any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts; pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts, or grant any Title of Nobility.

Purchasing from a restaurant is a contract between the individual and the owners of said restaurant. This ordinance impairs the obligation of a contract by forcing the restaurant to offer certain products. Once could also argue that under the Ninth Amendment that the ordinance violates freedom of choice.
 
If people were rational, they wouldn't have such an obesity problem in the United States. Clearly, people are not really capable of handling the complete freedom to choose what to consume. They therefore require guidance, assistance, and structure. People ultimately do better when they have authoritative leadership.

People do not know what's best for themselves, quite often. THus, adults need their own nannie with a neutral, outside-context view: the government.

This is just genius.

Instead of a small meal with a toy, parents will just buy the full size combo and lambast the the kids if they don't clean their plates.

The obesity problem stems from the US federal government's welfare to farmers and the use of High Fructose Corn Syrup in everything prepackaged. HFCS is processed much like alcohol is by the body and it stores the excess as fat. HFCS is also well documented that it doesn't trigger the I'm full receptors in the brain which leads to overeating. Add in the fact that the manufacturers have increased the amount of sugar in all prepackaged foods in order to use up as much of the excess HFCS on the market. The problem was started by the federal government with its farmer welfare and the mandated diet set down by federal regulations. Keep in mind that the diet endorsed by the federal government is an unhealthy one that is the result of a flawed study.

As is the case of Bad Frog Beer so shall be this issue, here.

You cannot try to take care of a "large problem" by just focusing on "one small aspect" - the Supreme court has set this precedent. If you want to tackle a public, widespread issue you MUST come down on EVER aspect of it - period.

So - the legal and legitimate approach to such things would be to: attempt to ban the advertising of all products using child-friendly characters and representation - for all products - retail or fast food. Everything.

Would that fly?
Nope.

It's just not going to happen.

It's hard to choose properly when the federal food guidelines are wrong and unhealthy. As for the lack of control, that goes hand in hand with HFCS not sending the signal to the brain to stop eating because they're full. Without this signal, the body thinks that it's starving and they are compelled to eat and eat until they do get full.

Looking at how fat those little kids are I seriously doubt they walked down to McDonalds. The weight problem of those children is the fault of the parents not McDonalds.

There are still a few of us left who don't subscribe to the Anti-American ideas of the Libeal Leftist who think people a generally really stupid and have no ability to make decisions for ourselves.

As it has been pointed out. It's not the fault of the happy meals ot the Parents who have little time to make a nutritious meal because they are busy working two and three jobs.

I was very lucky I never had a nanny or even a baby sitter beacuse my Mom was able to be a stay at home Mom.

Today not only is that rare, but having a Mom and Da who still live together is rare.

We also have to include the truth in this discussion, that being that the cost of education has been adversely effected by Teachers Unions that have forced the cost of education to a point that physical education has gone the way of the great AUK, lending a lot to the problem of lack of exercise every darn day.

I am giving an early heads up. You had best be ready to either fight the coming control over everything you do, say, eat, or think, or prepare to sit down, shut the hell up, and do what the "Trifecta of Doom, Obama, Pelosi, Reid, tells you, because you are too damn dumb to think or make basic decisions for yourself, you dumb ass.
