    I'm amused at those who say we shouldn't graffiti a flag on a hillside . . . even when burning a flag is protected by freedom of speech.

    Isn't a flag represented in any fashion, then, also protected by freedom of speech?

    If you can burn it, surely, you can paint it

    I know there's flag-code and a proper way to do things . .. but the SCOTUS really threw all of that out the window.

    A person can buy a flag and burn it. The hillside is public property.

It prohibits the flag in advertising, it creates a misdemeanor applicable only in DC of selling the flag as a tourist trinket, and it defines "flag" for the purposes of the entirety of flag code. US Statutes aren't really arranged logically, but they are still very much the law of the land, you just have to read them.

    The only governing regulation is to retire a worn-out or unusable flag by "honorable" means, preferably burning. Tattered flags and flags on t-shirts, ought to be burned. When that isn't possible, flags made of plastic or asbestos, then you retire them some other dignified way, like burying, or in this case painting over.
