Not So Neighborly Associations Foreclosing On Homes

Maybe you've tried to make reasonable HOAs. But there are many many unreasonable ones. And for those, the board members should be brought out on the street and executed one by one. You try to steal a man's house, you may end up dead. And that's not an unreasonable reaction.

I definitely sign on to this idea.

Hopefully, all those who supported the sale of this house, find themselves in very bad predicaments in the future.
It's the least they deserve.

A soldier serving in Iraq lost his Frisco home to foreclosure over late homeowners association dues, renewing a debate over the power of HOAs in Texas.

The case, which has boiled over to involve a federal judge, a publicist and death threats, began when Michael and May Clauer lost their $315,000 home to foreclosure in May 2008 after falling behind on their association dues.

The Heritage Lakes Homeowners Association was initially owed $977.55 and sent multiple notices by certified mail demanding payment. All went unanswered, said David Margulies, spokesman for the association and its management company, Select Management.

They drive me nuts, too, but so does the next door neighbor with five cars out front and a yard full of weeds.

I just built my dream home a couple of years ago, and it's amazing the number of rules of the HOA. Now, most of them are pretty obvious, but wow, you have to get approval to do just about anything outside your home.

Well it has its advantages. I have three swimming pools with a club house, the landscaping is taken care of and there is gate.

I must admit, I only have one swimming pool, a separate garage and office, my landscaper is larry, and I have live in a neighborhood that needs no gates.
 
I recently got citied for fixing a rotting fence installed by the HOA and that was rotting because of the HOA owned sprinkler system that for some reason sprays not just the grass area next to my house but my house as well. All I did was replace the fence boards with the exact same wood. The only reason they noticed was because it wasn't rotted anymore.

In response to all those people saying "never be part of an HOA". That's hard to do when 99% of the communities in a given area are HOA run.

To the OP story, horrible law that is lacking common sense and should be amended.

We really have very few HOA's in north Jersey as far as I can tell. :shrug:

I am glad in this case that he might have some legal recourse and be able to get his house back. What a nightmare.

But can you imagine moving back in and having to see the person who bought up your house (the first person) who was on the HOA? ugh
 
HOAs are the reason why we bought our house in Denton (20 mi. North of Dallas). We still have a self appointed anonymous leader that sends computer printout nasty letters to us and several of our neighbors for every little thing. We haven't figured out who it is yet, but I foresee having some fun if we ever do find out who this clown is.

Obviously, the secret enforcer wouldn't have any home foreclosure powers. And once discovered, would be exiled from the neighborhood. I hope they understand that this could happen to them.
 
I cannot comprehend how an organization can do that. How can they confiscate what isn't theirs, never was theirs, and something they have no stake in. Someone owes $1000 and the law actually says that because they owe someone $1000 they must lose their $300,000 home? Why in the **** isn't someone doing something to prevent this kind of ****ing nonsense? That is absolutely insane.

That said, I'd never, EVER buy a home where I was required to be in an HOA. I was a roomate with someone who was RENTING a home in an HOA area. She had two ****ing pre-school kids and wasn't allowed to have a single toy on the porch or in the yard. Not a single one. Nothing. If she wanted to put a ****ing PLANT on the porch she had to get permission. There is no way in ****ing hell I would actually PAY an organization to have that kind of asinine control over every little thing that I do.

Just out of curiosuty, has no one tried to search for his/her ip or by email address?
 
I know foreclosures were going on under Bush. That is not what I said at all. It is just that the media was make a much bigger deal about it. The evil corporation and big government vs. the poor unfortunate homeowner was being played up in a big way. Republicans were personally putting people out of their homes. Now, not so much.

Yea, he kicked my ass over it. Time for me to either get new glasses or a new brain. LOL.

These things sound like they don't hold up to the law.

I'm sure you can fight the sales contract as invalid.
There has got to be some legal provisions that account for things like this.
The guy who foreclosed on them has got to be a gigantic asshole.
