and just because previous courts have allowed other crap to remain does not preclude educated people from continuing to say it is unconstitutional.

shoot some truth serum into just about any federal judge and they would say that stuff like social security, federal gun laws and the war on drugs clearly violate the tenth amendment

Which means, had they put the Public Option in, and made it a tax, it would have been Constitutional?

Just playing Devil's advocate here, and I do like your answer.

I'd have to say yes since it would be provided by the government and paid for in the form of a tax.

Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other.

No, not really. Many have already proclaimed that they will pay the nominal penalty per year until they actually need coverage, then they will just jump on board. However, you can not legislate personal responsibility. People will get it, or they won't. Using governmental force, is not American in the slightest.

Critz's convincing win has to be a severe blow to Republican hopes to win control of the House. They nationalized the campaign, attacking Pelosi, Reed and Obama while Critz focused on local issues. Result: easy victory for the Democrat. This race will be repeated across the nation this fall.

There is a lot of time between now and this fall, and people are clearly dissatisfied with incumbents right now.

I think this hits the nail on the head. individual races can indeed be won locally, especially when you have a candidate in a heavily gerrymandered district, that lies about who he really is. But on a national scale, it isn't the R or D after the name, it is the incumbent tag.

Did you notice how Obama campaigned for Critz? Here is a District where Democrats outnumber Republicans by a 2 to 1 Margin and you are taking partisan victory laps for a candidate that did not ask for Obama's help nor did he run on anything Obama has proposed and in fact is about as anti Obama as the Republican candidate.

What you are showing is that for a Democrat to get elected they have to run as a Conservative. Not sure that Critz will even win in November as he is up for re-election but enjoy the perceived victory.

The PVI for the district is R+1. The people there, whether Democrat or Republican, are, for the most part, pretty independent.

Here is the mistake the GOP made. Running a national campaign for their guy, when the voters were concentrating on local issues. But that's OK. The GOP can learn from their mistake, and I predict that, while not getting a landslide, the prospects for Republicans this fall are pretty good. They won't win back the House, but allied with Conservative Dems, they will effectively tie Obama's hands.

I think Obama's waterloo is going to be the so called, "Immigration reform"

Whenever politicians talk about reform, beware.
