    That has nothing to do with the dispute over the interpretation of the Constitution. Neither the idea that the constitution embodies a right to privacy that includes abortion nor the idea that the eighth amendment bans capital punishment are the result of new technology. They're the result of judges pretending that the Constitution should be redefined to fit their policy desires.

    Again, if you refuse to engage in the slightest bit of self-education re: corporate personhood, I'm not sure why you would expect anyone to take you seriously. Read First National Bank v. Belotti. Corporations have always enjoyed many of the same privileges as persons, and it's by no means a "right-wing" idea.

    Kagan is almost certainly a lesbian. I doubt many other than the most strident social conservatives or social liberals will give a ****. Most other people will support or oppose her based on her philosophy and her record or lack thereof.

    Time for me to weigh in on this, and I am going to very much enjoy posting this.

    I have a huge problem with Kagan. But I posted the same reason when Bush nominated Meiers, and was extensively attacked and told that my opposition to Bush's pick was only because I was a Bush hater. Ironically, many of the same people who supported Meiers, and who did not think much of the reason I was against her, are now bashing Kagan for the same reason.

    Unlike many of those hypocrital political hacks who were attacking me when I posted against Meiers, I am true to my beliefs, and will now proudly, once again state the reason for my opposition to Kagan, which is the exact same reason I was against Bush's pick of Harriet Meiers.......

    She has no judicial experience.

    How about that? And I can say this without the least bit of hypocrisy, because I did not make my decision just because someone had an R or a D next to their name. To those who did, or those who are, put that in your pipes and smoke it.

    Unlike a few here, I have earned the right to bash Obama, because I don't bash him just because he is Obama. And I didn't bash Bush just because he was Bush. And, finally, I never once flip-flopped on this issue, on the basis of who the president is or was at any particular time. I called it exactly as I saw it when Bush was in office, and I call it the exact same way now. I can't speak for anyone else, but personally, it feels damn good not to be owned by one side or the other. My political compass is in excellent working order, thank you.

    Dick Morris in pantyhose is how someone described her. Actually given their two proclivities, Dick Morris probably wears pantyhose more than Kagan. one of my colleagues, a Harvard Magna noted that everyone at Harvard assumed she was gay (and he is a liberal Jewish guy who worked for Obama's campaign) but said she was a pretty good dean of the HLS.

    She was picked because I believe she is seen as easier to confirm while keeping women happy. That there are no protestants on the court doesn't really bother me but given the quota games Obama plays it is worth noting

    I also note that judicial experience is actually LEAST IMPORTANT at the Supreme Court level given how decisions are made. It is at the TRIAL LEVEL that a judge-all by him or herself-must rule on objections ASAP. Supreme court justices have 8 other justices and several brilliant law clerks to bounce ideas off-There have been top justices with no experience including CJ Rehnquist and liberal Icon Earl Warren.

    I am old fashioned in the sense I think a president should be able to pick whomever they want as long as t hey are competent. Is Kagan the best possible liberal? of course not. If you wanted a Jewish Lesbian then Pam Karlan is better but she is probably too liberal. Akhil Reed Amar is certainly smarter as well. But she certainly is qualified
