To fix that, Brodsky introduced a new bill in Albany that would enroll all New Yorkers as an organ donor, unless they actually opt out of organ donation. It would be the first law of its kind in the United States.

"Overseas, 24 nations have it. Israel has it. Others have it. And it works without a lot of controversy," Brodsky said.

My wife is an organ recipient and of course I am beyond thankfull to the live donor who vOlunteered to donate. Obviously this proposed idiot law is for cadaver donations yet how in the hell can any bufoon politician even think of making something like organ donations "manditory" even post mortem !

I of coursehave VOLUNTARILY gotten back on the donor designation LIST now that hey "think" that my cancer is in remission.

New York sucks. If I lived in New York if this passed it would be an reason for me to go out and drink so much my liver would not be useful.

This simply changes it from opt in to opt out. When you get your license, you are automatically signed up as a donor, and you simply have to check a box or fill out a form to not be one.

It might go too far, I dont' know, but it's certainly not making it mandatory.

In Spain everyone is an organ donor automatically. You can take yourself off the list though. Imo the best system of all.

OK I see the opt out clause but still to signed people onto the organ donor list and force them to OPT OUT is wrong. Have you ever forgotten to check a box or checked one by accident ? I do not want anyone to be put on an organ list by default. That is what this OPT OUT process casues and that is wrong.

I think that anyone who even hints that they believe in the Constitution or the Bill of Rights should philosophically be opposed to this sort of nonsnse and game playing.

I would say to Albany OPT THIS !!

Yes, but I own my organs. It's not up to the government to say that I'll be donating them, even if they give an "opt out". It's the opposite. They're my organs, they are mine less I specify that I wish to donate them.

Yes it's still property. Does dying make a house any less "property"? Can you not will it down to certain people if you wish? The government doesn't come in there and take it and redistribute it as they see fit, you get to dictate what happens to your property once you die.

Actually, unless you leave a will, the government will decide what to do with your property. So this isn't that different. Unless you leave specific wishes (opt out) the government will decide where your organs go.

Still not saying I support this though, since the body is much more personal than property.

You would rather be buried with your organs, for really no practical reason (they're going to degrade anyways), rather then possibly save someone's life?
 
You know what? In reality it's up to the next of kin. If they object it ain't happening, if they say yes, then it happens...

No one in the hospital checks the little check on the person's driver's license. That's just a feel good thing with no bearing on real life. In in the real world the next of kin is approached, and they decide.
