    What about the Contracts Clause of the U.S. Constitution?

    "No State shall enter into any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts; pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts, or grant any Title of Nobility."

    Does legal marriage require a legal contract?

    As you well know, someone has to petition the Court to hear a case before they can render a decision, and plenty of times they refuse to hear a case for a variety of reasons.

    Making simple, straightforward arguments well-rooted in Constitutional principles won't score you any points with the bigots.

    That's hardly the only reason they ever refuse to hear a case.

    Additionally, I'm not aware of anybody petitioning the Court in a challenge to that law. Maybe it just hasn't happened yet.

    Strip all marriage benefits from the tax codes. Disentangle the sacrament of marriage from civil matters altogether.
