Yeah, and probable cause has to be documented. Have you seen what has happened with departments that have large numbers of stops without documenting probable cause appropriately? They get sued, and in some cases, the officers involved and their leadership are disciplined. And the plaintiffs get cash awards.

And yet, that's the standard you want to uphold. Brilliant.

One time when I was in my early 20's, I was the passenger of a car that got pulled over. I thought I might have a warrant out for my arrest for something else, so I pretended I didn't have my ID on me and gave a fake name and DOB as a gamble to avoid the warrant (which it turns out didn't exist).

Nothing happened. He apparently didn't even check the info out. It was a calculated gamble since the reason my buddy got pulled over was for expired plates and nothing else had been going on.

Doesn't mean he couldn't have.....:roll:

I'm sure he could have. In fact, he probably would have if I was of a darker skin tone.

So, you agree he was within his right as a LEO to pursue his investigation further if he deemed it fit to do so.......

And you know what? I'm okay with that, versus undermining the fundamental constitutional rights of our nation.

You're espousing a short-sighted dangerous path for us.

There are a lot of ways to deal with illegal immigration. This is NOT an effective or legal approach.

If not, off to the stripey hole with you & rightfully so.....;)

If someone is involved in commission of a crime, and driving without a license IS a crime, not to mention running a stoplight, they are going to run a check for warrants and other criminal behavior and verify your identification.

The scenario described above? Chock full of LEGAL reasonable cause. That isn't what YOU are advocating.
 
What investigation? He wasn't involved in one.

Researching his expired tabs was the investigation....
Maybe you could have looked like someone in the posted on the wall of the local precinct, that would be probable cause for further investigation....;)

If no ID is proffered, they get hauled off to jail with ZERO SUSPICION OF CRIMINAL ACTIVITY and held until they prove that they're a citizen. And that seems legal to you and how the police should be doing business?
