And you have a right to legal counsel, to see the evidence presented against you, and to file civil litigation of the department violates your rights. A charge of public inebriation is meaningless without a breathalyzer. How exactly does one falsify a breathalyzer report?
 
You are being intentionally obtuse because you have lost this debate.

I'm suggesting that law enforcement officers have a primary responsibility to FOLLOW THE LAW, including upholding the bill of rights. Every police protocol in every department I've ever worked with/for has been focused around that goal. Jesus Christ, do you want to live in a country where police routinely violate the protections of the bill of rights? Holy ****.

This conversation is ****ing blowing my mind. An alleged conservative wishes to abdicate the fundamental protections of the bill of rights, and is encouraging a police department that is doing this? CRAZY ****.

What I'm saying is that all they need is probable cause for initial contact.....
Whatever happens after that is anyone's call.....
If you have no ID, they can hold you & run your prints through the system....
 
I have........ got stopped for not signaling in time and I had forgotten to take my wallet with me. It happens all of the time, that's why they have that law on the books in every State.

No they do not. If you get stopped without ID on you, the most that's going to happen is they will ask for your name and DOB, state your ID was issued, and maybe your social...then they will call it in and let you go when it comes back cleared.
 
That's because you aren't allowed TO DRIVE without a driver's license and proof of insurance.

But that's not what we're talking about here. We're talking about the police WALKING UP TO A PERSON ON THE STREET AND DEMANDING TO SEE IDENTIFICATION THAT PROVES THAT THEY ARE A U.S. CITIZEN. That's a violation of the 4th Amendment.

So they could have written me a ticket (they did when they released me) and sent me on my way (they held for 18 hours until the prints came back and no wants or warrants were found).

Give it up, Joe isn't doing anything illegal or immoral, he just pisses you off because he is cleaning up what the politicians don't have the guts to fix.

They could have, it's largely officer discretion. In most jurisdictions, an officer is not going to hold you for driving without a license. I suspect you were doing more than that. If not, you have reasonable cause to speak to an attorney as that was an inappropriate response by the officer involved.

I don't know. My info has always checked out. If your info doesn't check out, I imagine there are bigger issues than you not having your physical ID on you.

Generally speaking, if it is only driving without a license, you'll be cited and released. They may impound your vehicle and require someone to come and get you because you are driving illegally. But you typically are not going to be thrown in a jail cell because you can't cough up government I.D. THAT IS NOT A CRIME IN AND OF ITSELF.

And you can't even be asked for ID unless you're suspected of being involved in some kind of illegal act.

Nothing to speak to an attorney about..... they were totally within the laws of ever State in the Union.

All it takes is a call to the dmv or a couple of clicks on their computers right there in the patrol car. What century are you living in?

One time when I was in my early 20's, I was the passenger of a car that got pulled over. I thought I might have a warrant out for my arrest for something else, so I pretended I didn't have my ID on me and gave a fake name and DOB as a gamble to avoid the warrant (which it turns out didn't exist).

Nothing happened. He apparently didn't even check the info out. It was a calculated gamble since the reason my buddy got pulled over was for expired plates and nothing else had been going on.

You keep trying to get around the probable cause & it won't work....
Once contact has been made for probable cause, you will need to show a valid ID....:roll:
If you can't, it is up to the disgression of the LEO as to where you go from there......:roll:
