Anywhere between 90 and 300 terrorists, depending how you count them, have been convicted in civilian courts. Richard Reid, the shoe bomber, was arrested and was ready to be tried in a civilian court in Boston. Until he confessed, you didn't hear these whiney cries from the people of Boston over his upcoming civilian trial, did we?

You said we've tried 99% of terrorists in civilian court. I find it hard to believe that virtually every terrorist we've captured has been processed in such a manner, especially when we are holding several terrorists indefinitely or handing them over to foreign intelligence agencies for interrogation. This doesn't even take into account the fact that Obama orders extra-judicial killings of terrorists (predator drones) almost everyday. Why doesn't the far-left take exception to that?

I have a better idea. Let's extract as much intel from him as possible using whatever means necessary and shoot him in the back of the head. Then we can take pictures of his dead body and circulate them throughout terrorist hot-zones with a message that reads, "You're next."

If you want to send the Jihadists a stern message, having a show trial in New York isn't really the way to do it.

For real. As if the US using a civilian court for KSM will change the hearts and minds of jihadists, and silence criticisms of the US from the far left in america, europe and elsewhere :roll:

Do you really think a jihadist will drop his lifetime of teachings and hatred because we tried someone in a civilian court? apparently we have tried "99%" of terrorists in civilian courts already. Isn't that good enough? Shouldn't the hearts and minds have already changed due to this irrefutable "fact"?
 
I think the biggest downside to a civilian trial is that the defense is guaranteed the process of Discovery, which means that whatever information/sources the prosecution plans to utilize at trial must be provided to the defense before the trial begins. The defense could subpoena such people to testify (under direct/cross examination) in open court. Such intimate information could severely compromise US and foreign intelligence/military personnel and related assets.

Military Tribunals 15% only 3 out of 20

Federal courts around 90% 119 terrorism cases involving 298 defendants

Then educate yourself on the subject. Everyone of them we've tried except 3 has been in civilian, federal, court. Only 3 have been tried and convicted in a military tribunal. 2 of them got less than a year and are out free right now.
