The Obama administration will propose that the federal government take over safety regulation of the nation's subway and light-rail systems, responding to what it says is haphazard and ineffective oversight by state agencies.

Under the proposal, the U.S. Department of Transportation would do for transit what it does for airlines and Amtrak: set and enforce federal regulations to ensure that millions of passengers get to their destinations safely. Administration officials said the plan will be presented in coming weeks to Congress, which must approve a change in the law.

The proposal would affect every subway and light-rail system in the country, including large systems in Washington, New York, Boston, Los Angeles and San Francisco.

And the tentacles grow... all in the name of "making your life safer". In this case, it's just more Government, because the locals can't do it right...

Looks like the marvelous safety record of Amtrak will be greatly expanded.

"Government's view of the economy could be summed up in a few short phrases: If it moves, tax it. If it keeps moving, regulate it. And if it stops moving, subsidize it." - Ronald Reagan.....;)
The "Great Communicator" nailed that one.....
This country could sure use a leader like him right now.....:)

I assume the commerce clause, as usual......

I don't see how the commerce clause would apply since in the majority of cases subways aren't crossing state lines. Even in the few that do, like the NYC transit system, I still don't see how it qualifies.

Even with your original questions, though, they could be answered with the Tenth Amendment.

They use the commerce clause as the excuse for everything the federal governement does, but it is just a guess at this point.

It would be nice if the government would use the Commerce clause to allow interstate health insurance sales.

The subway in NYC does not cross state lines. You are talking about the PATH trains.

It's a good thing we don't let private companies run the rails. Imagine that, there would be an accident every day and those evil companies would profit off our misery!

Yeh, give the big banks, a couple of tons of fresh printed money that they can invest overseas and our own small businesses(where the new jobs come from) get the squeeze. :(
