Anti-Palin Book to Look Strikingly Similar to Palin's Own Book

I see a BIG lawsuit in someone's future. Liable, copywrite infringement. Did they get Palin's permission to use her photo? Probably not.

The picture was probably in the public domain and owned by the photographer. As far as "Going Rouge," satire is a well-established tradition in the U.S. and tends to be protected as a form of free expression.
 
I think what it really boils down to, is that the Libbos won't allow the Republicans to put the first woman president in the White House. Can you imagine the trash talk that PBO would have endured if had been a Conservative? The Libbos would have called him everything from Uncle Tom to porch monkey.

I'd love to see a woman in the presidency, but I would prefer that she not be a complete idiot. Or, for that matter, Hilary.

I do, in fact the second one on the list was started by a conservative. At one time a month or so ago I did an actual count, and about a third of Palin threads where started by those who identified as conservatives.

I would point out that if you did a similar search for Obama, or Pelosi, or Reid, or Clinton, you would probably find that most are started by conservatives. Wonder what that tells us?

Don't bad mouth Clinton now. She may have lost to Obama fair and square, but I still think she was a better choice for president. She has been the victim of some of the most negative press anywhere(until this year), and is probably nothing like she is portrayed.

A woman in office would be no different than all the crap we deal with now. It's not like it would be a better situation for us. Different gender, same ****. Gender to me is a non issue, I don't care. What I care about is political platform. And that you have an IQ at least of that of a normal human instead of a brain dead monkey. Palin is an idiot and I don't care about her. So long as she keeps away from public office, I don't care what she says, or writes, or whatever.

While I also despise pretty much everything about Hillary, she may have indeed been a better president than Obama. That's nothing to Hillary's credit, it just goes to demonstrate how ****ty of a President Obama is. I think I'd rather have Bush back if we could nix Cheney.

I'm not sure that you really understand what a trademark is. We're not talking about the golden arches here... (Coming To American, McDowell's restaurant). Pick up the book. Look at it. Read the title.

And you can't copywrite an idea, only the expression of the idea.

The dark skies book could be seen as a parody of the Palin's book.

Parody is only "fair use" for copyright, not trademark. Trademark is for an entirely different purpose than copyright. The level to which a parody would excuse something has to do with the level of market confusion and nothing else. This has great potential for confusion.

Copywrite infringement would most likley be a factor if the contents were copied. No one needs to get permission to her picture since she is a pubic official and her image was already splattered all over the public sphere.

Have you seen any of those there scared LIBBO'S? What they be scared of ?
 
Well, usually, lawsuits are all about who gets tired of spending money first. Sarah just got a $7 million advance on her book. I bet she wouldn't be afraid to drop a couple, or three million to make this piece-a-crap go away and I'm betting that OR Books don't have that kind of capital laying around.

why is the other book "crap" ? Have you read it ? Is there anything that is not true in it ? Are you saying that the other book's writers/publishers do not a have right to write ? Last that I checked this was a free country unless Nixon is back in office!!

The photographer most likely owns the copyright and if she signed a release there ain't diddly she can do about it from that angle.

I didn't know public figures really needed to sign releases. I thought it was implied at such events and with such people. I can see her suing to remove the image from the work but then what? They can find an image by somebody who does have a release form, change the hue on her jacket and presto.

Palin is a public figure who gets photographed all the time. A photojournalist would own the copywrite.

The similarity to the cover of Palin's book cover is the only issue. Palin's publisher could argue that a customer might pick up the dark cloud nightmare book by mistake. But even that's a stretch since many book covers looks similar and it is up to the customer to actually read the title of the book he/she plans to purchase.

In which case, the attorney for Palin's publisher could argue that people likely to purchase Palin's book are not too bright and a can't read above a 4th grade level.

If the essays are of the humorous variety, which is very likely because well... Palin is just so funny...in a scary way, then the book would be considered a parody or satire of Palin's book. Case closed, end of story.
