    Not likely a copyright issue. However, there is big potential for market confusion, which is the heart of trademark law.

    Palin is a public figure who gets photographed all the time. A photojournalist would own the copywrite.

    The similarity to the cover of Palin's book cover is the only issue. Palin's publisher could argue that a customer might pick up the dark cloud nightmare book by mistake. But even that's a stretch since many book covers looks similar and it is up to the customer to actually read the title of the book he/she plans to purchase.

    In which case, the attorney for Palin's publisher could argue that people likely to purchase Palin's book are not too bright and a can't read above a 4th grade level.

    If the essays are of the humorous variety, which is very likely because well... Palin is just so funny...in a scary way, then the book would be considered a parody or satire of Palin's book. Case closed, end of story.

    I doubt she would never need to spend much. Palin has a solid case of infringement that would be futile for the anti-Palin book writers to defend against in court.

    From what I have read about the anti-palin book it doesn't have a solid established publishing house for well placed distribution (this is the first book for the publisher) and it is only coming out in paperback. It won't be seen anywhere near Palin's book. Hell it's not even on Amazon and you can find books on Amazon that aren't even written yet.

    No, they argue that the book is obviously intended to appear very, very similar to Palin's book, and that it causes market confusion because you do have to look very, very carefully to make sure you're getting the right one. That's the heart of trademark.

    Obviously you got your law degree from 7/11... it won't be Sarah suing them.. It'll be the owners of the book.. the p.u.b.l.i.s.h.e.r... I'm not a lawyer either but I know a little about copyrights! or at least I've seen the inside of a couple books!
