President Barack Obama pledged to end the ban on homosexuals serving openly in the military in a speech Saturday, but acknowledged to a cheering crowd that the policy changes he promised on the campaign trail are not coming as quickly as they expected.


DADT was a horrible policy from the start. Clinton should have ended the ban on gays in the military rather than agreeing to this compromise.

DADT rewarded lying and deceit and punished honesty. It doesn't take much of a brain to understand that there is obviously something wrong with that.

Good news...unfortunately it's up to Congress, not the President.

I can only hope this ancient policy goes away.
 
All fine and dandy but who is going to go and tell the Military that they are going to have to change the UCMJ. Oh wait they can't because it's a US Code which can't be changed unless The United States Supreme court rule's it and the USSC has never overturned any UCMJ.

Are you suggesting that the UCMJ is written in stone and cannot be changed even if ordered too do so by the Commander in Cheif?

Yes not even the President can order the UCMJ change the only way they(UCMJ) can be changed is by the United States Supreme Court. This is why we have the Don't ask Don't Tell.

I'm not sure where you're getting this, but this is just incorrect. Congress instituted DADT and Congress can repeal DADT any time it wants.

The courts have absolutely minimal control over anything the military does.
 
As to the OP, I'll believe it when I see it.

The dems in the NY State Senate had been promising to legalize gay marriage for years, but said that they couldn't do it because there was Republican control over one house and a Republican governor. Now, they've had all three branches for over a year and we still don't have a bill. It's bull****.

No the only the Supreme Court can change actual parts of the UCMJ, the DADT was a compermise that the USSC let the Military and Congress come up with.

Look up section 925 Art. 125 of the UCMJ, this is why DADT came to be also to a lesser part section 907 Art. 107

Actually, as Commander in Chief of the armed forces, all Obama has to do to end DADT is to issue an executive order ending it.

The UCMJ is Title 10, Chapter 47 of the United States Code.

It's statutory law, passed by Congress and signed by the President.

Yes and No the actual Laws can only be over turned by USSC not Congress or the President.

Question do any of you actually know what Section 925 Art. 125 is huh. Or better yet do any of you know how the comp. came between Mr. Clinton/USSC/DoD for DADT.

Before any of you shot off your mouths I suggest you go and read what Section 925 Art 125 is then we can talk.

Obama can also issue an executive order abolishing Art. 125. Of course, there is a little bit of a hypocritical "gotcha" in doing this, because it would tend to go against Obama's opposition of the unitary president theory. But Bush opened up the door for him on this one. Like him or not, Bush frequently WAS the decider, based on his own use of executive orders. Obama could be a decider too, if he wants to be. And since the Democrats control Congress now, there won't be nearly as much opposition to an Obama executive order as there was to Bush's executive orders. Question is, does Obama have the guts to do it. Bush had the guts, and did it.
