Spain may open torture probe of six Bush officials

NEW YORK (Reuters) – A top Spanish court has moved toward starting a probe of six former Bush administration officials including ex-Attorney General Alberto Gonzales in connection with alleged torture of prisoners at Guantanamo Bay, The New York Times said on Saturday.

Spain can claim jurisdiction in the case because five Spanish citizens or residents who were prisoners at Guantanamo Bay say they were tortured there.

Spain has no jurisdiction here. It was not on their soil and Spain's rights are not being violated here. This is a matter for international courts, not a foreign municipal one. Nice try though, Spain.

However, it's all political grandstanding and has no merit at all. Unless any of those 6 are stupid enough to go to Spain and submit to these kangaroo trials... what's gonna happen? Nothing.

Or Spain imitates America and goes in and gets those 6 themselves. You act as if there's no chance of extradition.

Wrong! The one area in which the international community accepts a broad interpretation of universal jurisdiction is for torture. For example, a Spanish court demanded the extradition of August Pinochet on the grounds that some of the people he tortured were Spanish, and sure enough, he was arrested in Britain.

And what we did in the US was absolutely torture. A recent Red Cross review of our abuses showed that our interrogators went even further than the stuff we executed Gestapo interrogators for after WWII.

America was run for eight years by a criminal enterprise, the Bush crime family. Now we need to see to it that it never happens again.

Yeah, Spain's gonna make that happen... well, with Obama in office perhaps maybe he would try to have these people extradited, but even then, I seriously doubt it.

I suppose they could KIDNAP American citizens, and haul them away to Spain for trial, but that would really be grounds for all sorts of retaliation.. wars have started over far less.

If Spain does open probes, we can always open probes for their crimes against the indigenous people of Mexico back in the 1600's.

I'd be more excited if Spain went after real criminals like say... China, Cuba and NK... held trials on the abuses and tortures there. But no, they want to get people like HDL all excited for them. Ever since Spain capitulated to the Terrorist they've been tools.

Why doesn't Spain have any jurisdiction on whether or not Spaniard citizens have been tortured? If this was U.S. citizens being tortured by Arabs we'd see outcries for American intervention on the matter and middle fingers right and left to the U.N. for it's inaction regarding such matters.

The United States does not and has never accepted this notion.

Why? It did not occur on Spanish soil. It was on Cuban soil leased to the US and is under US jurisdiction. They were NOT taken from Spanish soil, they were taken from a third country. As such, Spanish law has no application in this case.

As for the situation you propose, that would be a matter for INTERNATIONAL courts to deal with OR the UN Security Council, NOT a municipal court in any state except the state the incident occurred in.

I guess Spain's economy must be roaring along if they're focusing on this right now. What a waste of money.

Oh, and as for extradition, there's no way in hell Obama would let that happen because he wouldn't want he and his cronies to face trumped up charges by some other country after he left office, and be shipped off like a common criminal.

They don't have jurisdiction over their own citizens if they are on foreign soil. Do you think the US has jurisdiction over its own citizens on foreign soil? The days of extraterritoriality are long over.

In a Special Trial created by the CPA. Persons accused of war crimes are supposed to be tried in the ICJ in The Hague, Netherlands.

Here's what this is all about in a nutshell. There's a certain small percent of the population in both the U.S. and Europe who are driven by a seething hatred of George W. Bush, his administration, his father, his wife, his children, and his dogs. Their hatred of all things Bush makes them single issue voters...

With Bush now a former president, these poor folks really don't have a clue what to do with all that pent up political rage. Bush is quietly jogging around Dallas and enjoying life, while Obama begins to ramp up for a 'surge' of his own in Afghanistan. The Bush-haters are confused, confounded, and in danger of losing their way. So a few of their buddies in Spain have given them some small glimmer of hope... and they'll play it for all its worth.

You know who's behind all this. Clinton democrats in the Obama administration. The're going all over the place stirring up hatred of Bush/America so Obama can say "told you so" and demonize the Republicans. It'll backfire and he'll make a fool out of himself. And we all suffer in the eyes of the world.
