TOKYO – A Japanese woman was likely impregnated with the fertilized egg of another woman by accident during an in vitro procedure last year, hospital officials said Thursday.

The woman, who is in her 20s, aborted the pregnancy when she was told of the potential mix-up at the government-run hospital in Kagawa prefecture, about 330 miles (530 kilometers) southwest of Tokyo.

She is now suing the local government for 20 million yen ($222,000), according to news reports.

Hospital officials apologized for the mistake at a news conference Thursday.

"She was very happy after undergoing such a difficult procedure and becoming pregnant, but unfortunately a mistake had been made," said Yuzo Matsumoto, director of the Kagawa Prefectural Central Hospital.

The hospital has a long history of carrying out such procedures, and this is the first time such a mistake has occurred, hospital spokesman Hajime Mori****a said.





Hmm, so when Obama brings us Nationalized healthcare, we will be able to sue the Government for screw ups? ;)

....sure. Go for it. Why wouldn't you be able to sue the government if it screws up? But hey. It might be a long time :

No.

I thought they really screwed up and used a chicken egg or something.
 
Maybe we should wait to see what happens with her case before we assume she can or cannot sue the government? In most developed nations, the supreme court has the final say if the government continues to dismiss legal action.

Also, most developed nations with nationalized healthcare have independent boards that review malpractice suits. Since taxpayer dollars foot the bill, taxpayers decide what process is used to deal with such cases.
 
Yes, because the govt gets to decide you are allowed to sue it or not.

Uhh the judges who would be ruling on the case aren't going to be paying the government's bills out of their own pocket. People sue the government (and win) all the time, for lots of different reasons. I don't see why this is, or should be, any different.

Yes, because the government can exempt itself, and use lawsuits to decide what they think is best for you.

Well then maybe that would light a fire under their asses to reform the tort system. It would certainly keep malpractice costs down.

I would completely support restrictions on the amount of money plaintiffs can get from malpractice cases (against the government or against private doctors/companies). I think they should be entitled to 100% of their medical bills and no more than $1M for pain and suffering or $5M for a wrongful death.
