Strange things keep happening in Minnesota, where the disputed recount in the Senate race between Norm Coleman and Al Franken may be nearing a dubious outcome. Thanks to the machinations of Democratic Secretary of State Mark Ritchie and a meek state Canvassing Board, Mr. Franken may emerge as an illegitimate victor.

Mr. Franken started the recount 215 votes behind Senator Coleman, but he now claims a 225-vote lead and suddenly the man who was insisting on "counting every vote" wants to shut the process down. He's getting help from Mr. Ritchie and his four fellow Canvassing Board members, who have delivered inconsistent rulings and are ignoring glaring problems with the tallies.

Franken isn't the one claiming the lead. The Republican dominated canvassing board is the one with the numbers.

As for the so called 250 absentee voters you claim were disenfranchised, these were not part of the "fifth pile", voters whose votes were not counted, that did not meet one of the 4 reasons under Minnesota law that they should not be counted. Coleman agreed with this before the recount started, but now that it did not go his way, as he thought it would, he seeks to change the rules at the 11th hour. The legal principle of estoppal and latches applies here, which is why the Minnesota Supreme Court is going to disallow his claim. You simply cannot argue for a set of rules, agree to that set of rules you argued for, then claim it is wrong, since you are the one who argued for it in the first place.

Tim Pawlenty has already announced that, as soon as the legal challenges are dealt with, he will issue a certificate giving Franken the win.

Perhaps if we had a no-bull**** fool proof voting system to begin with that didn't leave votes out or miscount votes or whatever it could be done right the first time. The sad thing is that when a recount occurs and the results change, even if it is legitimate the other side is going to feel disenfranchised or cheated.
