One of the countries most controversial sheriffs may face the other side of the law after a federal judge recommended that he face contempt charges.

U.S. District Judge Grant Murray Snow said Friday that he would ask prosecutors to charge Sheriff Joe Arpaio wth criminal contempt of court.

Noemi Romero, 24, was one of nine workers arrested in January 2013 after Maricopa County sheriff’s deputies raided Lam’s Supermarket, an Asian grocery store in Phoenix, looking for undocumented workers who were using other people’s Social Security numbers.

The name and Social Security number Romero was using belonged to her mother. She pleaded guilty to a felony charge of criminal impersonation. The felony conviction ruined her chances of applying for a federal program that allows undocumented immigrants brought to the U.S. as children to receive protection from deportation and a work permit. Romero was brought to the U.S. from Mexico when she was 3.

“When that happened to me, it was not just I that suffered, but my whole family suffered,” Romero said.

Romero spent three months and a week in jail.

She said of Arpaio, “I hope he does go to jail and is treated the way all these other people have been treated.”


It seems Obama justice department has been getting complaints that sheriff Joe enforces laws regarding fraudulent use of Social Security numbers.
 
I live in AZ. imo, the courts are sending mixed messages regarding MCSO.

One court says its illegal, another lifted the ban allowing to raids to continue.

Some may not like Sherriff Joe. Yet, I don't see the feds doing much on id theft, use of stolen ssn, sanctuary cities, etc. Drugs still flow across the border. People still enter the US illegally on a daily basis. Parts of our pubic land are posted to be aware of high drug smuggling activity and we should stay out.
 
Good luck with that. The prosecutor will have to prove he materially violated the court order and that the violation was not in the course of performing his job duties. If the violation occurred while enforcing the laws that exist on the books he will walk.
 
i remember thinking that this guy was a menace even when i was a right winger.

Arpaio broke the law...he has already admitted it. The judge ordered him to fix his department's problems, and he repeatedly thumbed his nose at him, he didn't follow the rule of law and he is in contempt of court. Now, after being found guilty in a civil hearing, he is going to face criminal trial. He is guilty, he is a pig, and his supporters live in a weird cult like universe.

Seems to me that Sheriff Arpaio is applying Arizona law as its written, as it was upheld by the Supreme Court, and through use of his and his officers' discretion outlined in the law.

As a result, seems Judge Snow has overstepped his own authority and the Sheriff is right to ignore the orders of Judge Snow's court.

I appreciate that liberals and Democrats absolutely abhor anyone who administers laws and adores elected officials, like the current President, who thumb their noses at the law and their oath of office. It's just a guess, but I'll bet Sheriff Arpaio is one of the most admired and popular men in America and that probably rots the socks of an egotistical blowhard like Judge Snow.

Let Snow try to have the Sheriff charged and arrested and let's see how far it goes in front of a jury and/or on appeal.

He has already admitted to it! And Judge Snow has already proved contempt of court in the civil hearing.

Joe didn't follow the rule of law, you know that all important rule of law....that he thumbed his nose at.

Snow already declared Arpaio and Sheridan guilty of civil contempt of his court in May of this year, finding that the two men had "deliberately" and "willfully" defied his orders in the ACLU's landmark civil-rights case Melendres v. Arpaio, in which Snow had found Arpaio and the MCSO at fault for widespread racial profiling of Latinos.

Intentional defiance is the bright line for criminal versus civil contempt charges under federal law, and Arpaio and Sheridan crossed it long ago, according to Snow.

As early as December 2011, Snow issued a preliminary injunction — later to be made permanent — that the MCSO could not enforce civil immigration law and could not hold individuals solely on the suspicion that they may be in the country without authorization (which is, in itself, not a crime).

But Arpaio thumbed his nose at the judge, publicly stating that he would continue to enforce immigration law and turn over non-criminal aliens to federal law enforcement, saying he had a "back door policy" to get around the judge's dictates.

"Sheriff Arpaio’s attorney and members of his command staff repeatedly advised him on what was necessary to comply with the Order," Snow writes in his decision. Nevertheless, "[Arpaio] continued to direct his deputies to arrest and deliver unauthorized persons to Sheridan and Arpaio's "history of obfuscation and subversion" merits criminal contempt, writes Snow.

Snow found that Arpaio and Sheridan intentionally ignored his order for 17 months. In fact, during a recent hearing in the case, the ACLU, which represents the plaintiff class of Latinos in Maricopa County, revealed that it had evidence the MCSO is still not in full compliance with the injunction. As a result, Snow invited the ACLU to file a motion for yet another possible civil contempt hearing.

Additionally, Snow ruled that both Sheridan and Arpaio had withheld evidence that Snow had ordered to be turned over to the court's monitor. In one instance, this involved 50 hard drives of material pertaining to the so-called Seattle investigation, which involved Arpaio's investigation of a non-existent conspiracy against the sheriff (supposedly involving Snow and many others) with the assistance of a purported computer guru.

No, not because of that. He has a long history of abuse, corruption and has cost his county tens of millions in settlement fees.

In a bombshell filing in federal court Tuesday, Sheriff Joe Arpaio and his Chief Deputy Jerry Sheridan admitted that they are guilty of civil contempt, in a blatant attempt to avoid an upcoming civil trial before U.S. District Court Judge G. Murray Snow.

Since earlier this year, when Snow ordered a four day civil contempt hearing to address allegations that Arpaio and four former and current aides have disobeyed the judge's orders in the ACLU's big racial profiling case, Melendres v. Arpaio, the sheriff and his co-defendants have sought to wiggle out of the de facto trial, scheduled for April.

(One exception: Former Deputy Chief Brian Sands, who according to his attorney Dennis Wilenchik, is willing to testify at the hearing and will not invoke his Fifth Amendment privilege.)

Arpaio and some of the others have sought assurances that the civil charges would not be forwarded to the U.S. Attorney's Office for possible criminal action, and have tried to settle the matter with the plaintiffs in the case, all to no avail.

Now, Arpaio and Sheridan are admitting wrongdoing, promising to make good, and pleading for mercy from Judge Snow.

We'll see what a jury has to say if this blowhard of a judge gets his way and charges are laid. Would love to see Arpiao's defense team drag the judge into the trial to defend his court orders and his charges of contempt, but the black robed gods and goddesses would probably protect the poor soul from appearing.
