Trump Campaign Manager Arrested, Charged with Battery of Reporter[W:155**494**]

Republican presidential candidate Donald Trump's campaign manager was arrested in Florida on Tuesday and charged with simple battery, police records show.

The report from the Jupiter Police Department said Corey Lewandowski was charged for intentionally grabbing and bruising the arm of Michelle Fields, a former reporter for the conservative news outlet Breitbart, against her will at a Trump campaign event on March 8.

"Mr. Lewandowski is absolutely innocent of this charge," Trump said in a statement. "He will enter a plea of not guilty and looks forward to his day in court. He is completely confident that he will be exonerated."

That is fundamentally inaccurate.

First, we have the individual that filed the allegation. Then we have Ben Terris, the Washington Post reporter who identified Corey Lewandowski as the one who assaulted Fields, published an eyewitness account. And, as Reverend HH just linked above (although he apparently thinks that pictures of bruises and video of the unwanted physical touching [READ: BATTERY] are evidence to the contrary), we have video and photographic evidence to corroborate their allegations.

And the police are not required to arrest after a criminal charge is filed. They clearly found corroborating evidence to support the charge and thus made the arrest.

Hey, Trump will get him a good attorney. I won't get picked for the jury but in order to convict him, I'd have to see a lot more evidence than I've seen so far of any assault.

2. The intentional causing of bodily harm to another person.

Where there are no aggravating factors or enhancements at play (such as use of a weapon, serious bodily injury, or domestic violence) the offense is known as “simple battery” or “misdemeanor battery.”

I get that you don't see the grab as being that much (as evidence by your commentary on her picture as "barely bruised"), but you have to understand that the common law definition of simple battery is a really, really low bar.

For example, if I tickle you when you told me that you do not want to be tickled, then I have committed simple battery. If I tell you that I am don't want to be around cigarette smoke, and then you intentionally take a drag and blow smoke into my face, then you have committed a simple battery. When physical injury results, even "barely bruised," then you definitely have a simple battery charge.

And no, I don't see his hand grab her arm because of the camera angle and the body in the way. So the evidence is circumstantial, but people are convicted based on circumstantial evidence alone all the time.
