EXCLUSIVE: A senior Hillary Clinton aide has maintained her top secret security clearance despite sending information now deemed classified to the Clinton Foundation and to then-Secretary of State Clinton's private unsecured email account, according to congressional letters obtained by Fox News.

Current and former intelligence officials say it is standard practice to suspend a clearance pending the outcome of an investigation. Yet in the case of Cheryl Mills, Clinton’s former chief of staff at the State Department, two letters indicate this practice is not being followed -- even as the Clinton email system remains the subject of an FBI investigation.

In an Oct. 30, 2015, letter to Senate Judiciary Committee Chairman Charles Grassley, R-Iowa -- who has been aggressively investigating the Clinton email case -- Mills' lawyer Beth A. Wilkinson confirmed that her client “has an active Top Secret clearance." The letter said previous reporting from the State Department that the clearance was no longer active was wrong and due to "an administrative error."

Mills was the one who reviewed Clinton’s emails before select documents were handed over to the State Department, and others were deleted.

So far, more than 1,800 have been deemed to contain classified information, and another 22 “top secret” emails have been considered too damaging to national security to release even with heavy redactions.

It may well be that Mills' clearance remains valid as investigators have determined that it would be necessary for her to review specific classified documents and to answer questions in their regard during the course of the investigation. We have no idea how Mills has been involved or will be involved in the investigation. My guess is that Clinton will throw most or all of the blame on Mills. But who effing knows?

I'm betting Mills has a fairly good idea. She's a bright lady. She knows full well that when the **** gets thick the Clintons always offer staff as fresh meat. In this case Mills is prime. With that in mind Cheryl Mills may have already been talking to the FBI and other 3 letter people. They would possibly need Mills to retain her clearance in order that emails and such could be reviewed and discussed.

It isn't as if Mills is out there getting fresh classified intel. I doubt that other than the Clinton investigation Mills no longer has any need to no.

The State Department isn't going to pull her clearance. Kennedy is in cockroach status trying to figure out how to deal with the email issue and stay out of jail. The FBI would have to step in and do it. If they jerked her clearance it would alert the media/reporters and I am sure they don't want to expose any of their investigation at this time. I agree with Risky that Mill's access is limited so there is no reason to start a fire prematurely. It makes one wonder how much dirt Mills has on everyone involved and if she is willing to fall on her sword for the Clintons.

Side note, the last batch of emails is being released today.

Both Trump and Hillary end up disqualified or jailed, and Obama passes an Executive Order to serve a third term in their place.

Crazy isn't it...that doesn't even sound impossible anymore.

It seems the only way for Hillary to get out of this mess is to become President, shut down the investigation, and pardon herself. Impeachment might follow shortly thereafter. In fact impeachment proceedings may begin even if she does become President.

The country would be in a turmoil, that's certain, but doubt the Celebrity Apprentice would be the leader the US needs at this juncture.

I wanted to vote for Rand--now I'm stuck with the strongest opponent of trump--probably little rubio.
Paul, Kasich, and Bush were all acceptable GOPs.

Paul's turn will come in 2020, when he's a sitting Senator with two years remaining.

We'll see if he tries to develop his own 3rd party.

McConnell is still indebted to him for his support in the 2014 primary.

The gop running a 3rd-party ticket of Kasich/Rubio is still on the table.
Time is running out to get them on all 50 state ballots .

After what I've seen out of the gop and its ussc since 2000, I'll take my chances.

You vote for your wrong person in a conservative part of CA.
I'll vote for mine here in Reagan DEM country of IL .

Think if this was a Republican running for President, and one of their aides had this baggage too?

You don't think this would be front page stuff for weeks/months until they demolished the candidate?

Hopefully Trumps administration will do some major house cleaning.
