It's called inciting violence. And those who would follow Trump's encouragement could end up being charged with "Assault". The definitions below are from Texas Statutes. Not all States impose the same penalties for a given crime.

Simple assault in Texas consists of:

intentionally, knowingly, or recklessly causing bodily injury to another person
intentionally or knowingly threatening another person with imminent bodily injury, or
intentionally or knowingly causing physical contact with another that the offender knows or reasonably should know the victim will find provocative or offensive.
(Tex. Penal Code Ann. § 22.01).

Bodily Injury

“Bodily injury” means physical pain, illness, or any impairment of physical condition. Simple assault involves only minor bodily injury like a cut, scrape, or bruise. Injury such as a broken bone, disfigurement, loss of a limb, or requiring surgery or hospitalization is a “serious bodily injury.” If the offender causes or threatens this kind of injury, the assault is considered an aggravated assault.

(Tex. Penal Code Ann. § 1.07).

And throwing a tomato might legally be considered as "battery".

Battery is an offense involving the unlawful physical acting upon a threat, distinct from assault which is the act of creating apprehension of such contact. In the United States, criminal battery, or simply battery, is the use of force against another, resulting in harm, or an offensive or sexual contact.

Harm principle refers to a theory of crime that an action can only be banned if it causes harm to someone. The principle does not say that if an action is harmful, it must be banned; instead it says that harmful actions are the only ones that can be banned. The harm principle simply sets a minimal standard for what sorts of actions can be justifiably prohibited.

Amount that is appropriate to stop the threat.

Shooting the tomato thrower would be a disproportionate response. Smacking him prior to release of the vegetable/fruit would be appropriate.

It doesn't matter what trump said. If the response to an assault (this case a tomato), or attempted assault is reasonable, No crime on the part of the one bitch slapping the liberal kook would have occurred.

The crime still would be with the lw jagoff.


People are responsible for themselves, there is no incitement if there is no imminent issue. your lack of understanding the law seems purposeful.

Why would a Liberal (kook) throw a mater at The Donald, only to be slapped by "The one", whom I shall deem as not a Liberal kook?

Wouldn't it be far more likely that said mater would come from the pitching arm of a Cruz supporter?

If Trump lands the nom, there's no hope for the GOP this time around.

Why show up to the Trump event in the first place? Obviously she had an agenda and trying to elicit a reaction.

If a KKK member protested a black lives matter rally would you defend it as "he dared to follow his faith and wear a white robe and pointy hate to the black lives matter event"
