You might want to read the law to avoid looking silly. Being kind, I will help: TEX PE. CODE ANN. § 48.02 : Texas Statutes - Section 48.02: PROHIBITION OF THE PURCHASE AND SALE OF HUMAN ORGANS

(b) A person commits an offense if he or she knowingly or intentionally offers to buy, offers to sell, acquires, receives, sells, or otherwise transfers any human organ for valuable consideration.

Like I said, that law makes the legislators look stupid.

What exactly do you think abortion involves? Do you think someone is perhaps killing another party? Seriously, you're asking me who is the killer? A woman goes to the clinic to have her unborn child killed and you need help in figuring out who the killer is. Seriously? WTF?

It's a fetus not a person or a child. Completely legal has been for years settled law. Now compelling a woman to have an abortion that I'd have a problem with.

So Texas is so stupid they didn't make intent part of their law? :lamo Why would someone pass a law that treats what essentially is a farce the same as the real thing? Texas really is full of ****ing retards.

I think there is a good defense in arguing intent. It will have to be proven to a jury. But I think they will understand what was done and why and actual intent to purchase might be hard to prove, all things given.

I think there is a good defense in arguing intent. It will have to be proven to a jury. But I think they will understand what was done and why and actual intent to purchase might be hard to prove, all things given.

It's too bad Texas apparently doesn't care about intent on these matters. In this case the guy pretended to be interested in buying organs and Texas will treat them exactly the same as someone that had intent to buy. The transaction had no hope of being completed and any law on organ sale should consider that, but in Texas the legislators are too stupid to think that far ahead. Could someone perhaps fake the sale? Nah, that would never happen.

I never said they weren't stupid for breaking the law, but that fact doesn't mean the law itself isn't stupid. Whoever wrote and voted for this law should be kicked out of office.

I don't see how that makes any sense. Why would I support legalized abortion because otherwise women would go out of their way to take part in activities that lead to their death?

What should we do with the males?

From what I have learned of US laws.
Bank robbery
1 into the bank - kills someone during the robbery
1 in that car- does not know
Both in many States are subject to the DP.
So what happens to the male?

Charges are based on intent in plenty of cases. If the individual never wanted to buy organs then what are you even protecting? There was no transaction that was ever going to be completed and no transaction that was completed, so by all accounts there should be no crime.

If I am reading this stuff right, the felony charge would be a second degree felony, therefore 2 to 20 years.

Yes, the law is written in such a way to make it crime to even be involved in the transaction at all. There has been plenty of cases where people pretended to be interested in a product to make the seller look bad, and this case isn't all that different. There is no reason to make it a crime to fake being interested in a transaction.
