Intent in law should always matter. If someone kills another person without malice we don't charge them with first degree murder and in this case we shouldn't pretend they were actually interested in getting organs. Intent matters.
Intent doesn't mean squat. If you go into a bank with a note and a gun, to just test their security, you are still going to go to prison. LOL.
