"In what appears to be the first “birther” challenge against Republican presidential candidate Ted Cruz, an 85-year-old Houston attorney filed a federal lawsuit on Thursday seeking to address what GOP front-runner Donald Trump has labeled the “big question mark on [Cruz’s] head” — that is, whether the Texas senator is a “natural born citizen” and, therefore, eligible to run for president.

“This 229 year question has never been pled, presented to or finally decided by or resolved by the U. S. Supreme Court,” said Newton B. Schwartz Sr. in his 28-page lawsuit filed Thursday in Texas’ Southern District Court. “Only the U.S. Supreme Court can finally decide, determine judicially and settle this issue now.”"

Well, we all knew it was only a matter of time, and Mr. Trump was right in that Sen Cruz' opposition would come after him! It just happened quicker than I thought!

I'm going to go out on a limb here, and say the filer will not be found to have standing. In fact, I believe standing will be difficult to find, even after the election. Which might be good for the Senator, because I'm beginning to believe this is a legitimate cloud. Perhaps not enough to get the Court to rule against the electorate in a Presidential election, but enough to say there is legitimate grey area concern!

It's not obvious, no, how this should work. I'm not sure that it's really legitimate, but the reality is that it will have to get addressed before Ted Cruz could become president. It would also be good for there to be a legitimate, legal definition of a natural born citizen.

With that said, I agree with you, I think the guy will have no legal standing and the case will be wiped out of existence. It would probably take Trump to sue, I might think or have the RNC sue Cruz.

I doubt that the court will go forward with the suit. The person that is suing has no standing. It would be nice to get the whole issue straightened out however.

He was not born on American soil. That means he's not a "natural born citizen" based on the original usage in the constitution.

There are 8 presidents who were not born on US soil, presidents : George Washington, John Adams, James Madison, Thomas Jefferson, James Monroe, John Quincy Adams, Andrew Jackson, and William Henry Harrison.

They were all born before the US was created.

A law suit has been raised. The court will rule on this. I don't think the law suit will succeed, and the court will rule in Cruz's favor, but we'll see.

SCOTUS will likely seek to avoid taking a stance if they can. At some point, if Cruz gets the nomination and the votes, i think they'll pretty much have to.

Yeah, that makes sense given their MO. In a similar law suit, Gore vs. Bush, that's exactly what they did, so it's reasonable to expect them to do the same in this case.
 
These people aren't birthers.

Birthers are conspiracy theory morons who believe Obama was born in Kenya despite proof to the contrary. The facts of their claims are wrong, but the implications would be accurate if the facts were true. They're challenging reality. Birthers will never see the issue as "settled" because they aren't working in the same reality as the rest of us.

Cruz's lawsuit has the correct facts, but is challenging the legal implications of those facts. They will consider the issue "settled" with a court ruling.
