Former Attorney General Michael Mukasey, appointed by President George W. Bush, has weighed in on the Clinton Email Scandal by discussing the comparison between Mrs. Clinton and his own prosecution of General Petraeus for the crime of unauthorized removal and retention of classified information.

"As the former U.S. attorney for the Western District of North Carolina, I oversaw the prosecution of Gen. Petraeus, and I can say, based on the known facts, this comparison has no merit. The key element that distinguishes Secretary Clinton’s email retention practices from Petraeus’ sharing of classified information is that Petraeus knowingly engaged in unlawful conduct, and that was the basis of his criminal liability."

I think we all know that this vote of confidence will not stop the political grandstanding (see Benghazi after 11 different investigations), but hopefully this discussion will help stop folks from continuing to claim that Mrs. Clinton should be prosecuted just as Petraeus.

So Hillary, head of the State Department, had no idea that she would be receiving and delivering classified material through her private Email server ?

A server she set up for the explicit purpose of circumventing congressional commitee and FOIA request ?

Really ?

So you are saying she was just too stupid to know processing classified information on her private email was illegal?

Two points here.

1. If you are going to give credence to his opinion then, Hillary did break the law. So all this she did nothing illegal talk can stop

2. Since when did ignorance of the law count as a defense? Not to mention that Hilary was one of the only people who was authorized to determine what was and wasnt classified. The excuse that she didnt knowingly do it doesnt hold water.

1) How did you reach the conclusion, based on his opinion, that she committed a crime when he explicitly states that she did not?

2) Ignorance of the law is not a defense; however, certain criminal laws require proof of a requisite mens rea. An intent to transmit information marked classified, at the time of the transmission, to a person without the requisite security clearance is required here. If you can not prove that the information was classified at the time, or that she knowingly transmitted that information to someone without the requisite security clearance, then you have not proven a crime.

No, Mr. Mukasey is saying that the information was either not marked classified at the time or that classified information was not knowingly transmitted to a third party who lacked the requisite security clearance.

She did not send or receive material marked classified at the time that it passed through her server.

Well, probably not, as it is more a question of whom it is intelligent to lend power and not like with the general a question of courts. In court the defendant must be assumed innocent till otherwise proven. In an election it is the other way around. If the candidate cannot show that he/she is innocent, only an idiot would normally take the chance. We are talking about entrusting someone with enormous power over the citizens. If there is any suspicion, you cannot do it.

He didn't claim she didn't break the law.

He claimed she didn't break the same law that Petraeus did.

She deleted thousands of Emails and then had her server professionally wiped before giving it to the FBI.

While certainly true, the crime of "unauthorized removal and retention of classified information" appears to be the primary allegation being made against Mrs. Clinton in regards to this case.

This is an opinion piece. Why is it in this part of the forum? It is under the opinion section of USA Today.

Yet another article that claims Hillary is an idiot and yet should be president.

I spent an entire career working in embassies. She would be an idiot not to recognize TS information. SECRET, I could possibly understand. Not TS. It screams in your face.
