Because someone has to enforce the contract when a party breaks from their agreement or their is a dispute over whether the contract is enforceable. The courts are part of the government, by the way. And the police (also part of the government), help to enforce the court's decision. Oh, and the legislature has to be involved to ensure that certain types of contracts (one for child labor, for example) are void on their face.

All hail the government. One must never challenge the government, even when they break the law. Henrin says it, so it must be,

I think it needs to be reargued under that argument.
SCOTUS decided a court case where the decision itself would create law. They did not break their previous ruling.

I agree government should stay out of the marriage business. It is a personal relationship between two people and they should make a contract setting the rules.

And yet with all this rhetoric and complaint by you, what the Supreme Court says is the law whether or not you like or agree with it. I guess you will have to just get over it.

I don't see why people wouldn't want that. They can set the terms of the contract and never have to worry about terms that might be added in the future they don't agree with or aren't allowed to be opted out of in pre-nup. Sure, it's more expensive, but I think the upside of taking that path far outweighs that.
