The islands, islets, reefs, are in the Exclusive Economic Zone of the Philippines which is why the Phils in 2013 took the case to the UN Tribunal on the International Law of the Sea. The UN Tribunal however has heard only the Phils side of the case as Beijing won't show up to argue its case, nor is it ever going to appear before the Tribunal, despite Beijing signing the ILOS treaty. The UN Tribunal is going to have to rule against Beijing on this.

The Pentagon sent last week a new high tech littoral combat ship USS Fort Worth through the area which caused a commotion in Beijing and ignited a cat and mouse contest between the two Navies and Air Forces.
