So I asked the chief deputy prosecutor if the mope was facing the DP and he just laughed and invoked the cockroach rule

    that being a mope who whacked other mopes normally didn't get charged with capital murder

    Sadly, that's not surprising. In fact if we were able to see what cops and DAs know in most of these shootouts I would imagine that of the bikers present at the time of the shootout 30% are informants and 30% are undercover law enforcement.
