No question that the arrest was illegal. Since he ran (or pedaled) from the police, I see no problem with stopping him but arresting him was a no no.

My charges will be thrown out prior or after on appeal. This was a obvious rush to charge these officers given the second degree murder charge against the driver.

It is common, unless really egregious, to find an Officer not guilty.
Way we look at Police Officers & what they do comes into play.

Which is really kinda interesting. BPD is roughly 50% black, the Chief is black, the Mayor is Black....the prosecutor is black, and Democrats have been running Baltimore since the 60s.....why haven't they "fixed" it?

Of the shooting victims so far this year in Chicago (659 and counting) here's the breakdown:

77.2% Black
18.6% Hispanic
4.2% White/Other

Excon is using what is referred to as retroactive cause. It's something that many police use as well. Make an arrest and then come up with a charge that sounds reasonable after the fact.

They can't fix it. To fix it they would have to acknowledge that it was their policies that were to blame. Hard work and self reliance were replaced with soul crushing welfare that incentivized the dissolution of the Black Family.

Not only will they refuse to acknowledge it, they've made it worse. Obama's extending unemployment benefits and food stamp enrollment as well as fostering class warfare by focusing on alleged income inequality. Liberal Policies that kill investment into communities and cities while unemployment is through the roof.

All it means is Cities like Baltimore will continue to be held hostage by crushing poverty, crime and dependence. But don't worry, people are going to pull together and stop this Police Brutality....Lol

No way in hell. Remember, according to the Mayor and Prosecutor its " Justice " for the Freddie they're after, even though in our Judicial system the ONLY one's truly entitled to Justice are the defendants. They're presumed Guilty and a fair trial is impossible.

and the follow up question is will the SA and the Mayor speak for the business and homeowners property that was burned, incurred theft, or damaged during the riots and the injured LEO / citizens done by the "protestors"?

Yes, LEO need to be held accountable for their actions. No one should be tried and convicted in the media. The public does not know all the facts / evidence yet.

Regardless of anyone's race, the fact of so many citizens dying at the hands of the government should be enough cause for alarm.

You don't need probable cause to chase someone.
 
Again, it's up to the DA or State's Attorney to decide what cases to try. There are hundreds of thousands of cases that are dropped each year because the Prosecutor didn't bring charges or allowed the accused to plea down.
Again? You went from claiming that the prosecutor has the authority to decide whether or not the knife was legal, to the prosecutor being responsible for what evidence the jury is allowed to consider, to (now) having the authority to decide what cases to pursue (which is something I'm finally able to agree with).
 
She stated it was legal under Maryland Law, not under the City Code charged.
Yes, I also thought that was strange. Whether or not the knife is legal under the state law tells us little about whether or not it is legal under the more stringent city laws.

The medical examiner ruled it was homicide.

Also, there are charges of negligent homicide, abuse of authority, etc.

It was an unlawful arrest, they claim, and their negligence concerning his safety when riding in the police van resulted in his death. They didn't put him in a seat belt, and he apparently fell in the van and broke his neck.

The charges seem appropriate.

The charges are overblown it seems and I doubt the cops will be convicted of the most serious charges-if any

Why would the knife violate the law? It would be covered by the Second Amendment.
According to NRA propoganda, the 2nd Amendment only applies to gunweilding White People.
 
You don't need probable cause to chase someone.

You need a crime in action or suspect one to justify probable cause. Running before a crime is established is not a crime thus.. you need probable cause to chase.

Well, they didn't know he had the knife when they started chasing him. So, again, you're not making sense.

That you think that matter means you are not making sense.

They had probable cause to chase and detain.
Had a knife not been found he would have been released and walked away. But a knife believing to be a violation of the law was found and that constitutes the probable cause.

Seeing a suspected drug deal with the participants fleeing is probable cause to give chase and detain. During that detention the knife was found.
Had it not been found he would have been released.





Why would the knife violate the law? It would be covered by the Second Amendment.
That is a different argument from what we are discussing.

Cops do not put their lives on the line daily. That is complete nonsense. Do they sometimes? Certainly. Daily? No. That's nonsense that the police PR machine feeds the public to justify their bad behavior and special rules that allow cops to skate for things that would land anyone else in prison.

45K salary? Maybe to start. With OT NYPD patrol officers routinely make 6 figures. Lots of cops live in Nassau and Suffolk counties. Decent houses here start at a quarter million. You do the math. Cops, at least here, are well paid, and typically retire after 20 years regardless of age. That means a typical cop retires in his early forties and collections a good pension for the rest of his life.
