Ted Cruz’s eligibility to be president haven’t drawn much attention, two former Justice Department lawyers have weighed in with a bipartisan verdict: Cruz, they say, is eligible to run for the White House. Neal Katyal, acting solicitor general in the Obama administration, and Paul Clemente, solicitor general in President George W. Bush’s administration, got out in front of the issue in a Harvard Law Review article. “There is no question that Senator Cruz has been a citizen from birth and is thus a ‘natural born Citizen’ within the meaning of the Constitution,” they wrote."

The lawyers wrote that the Supreme Court has long used British common law and enactments of the First Congress for guidance on defining a “natural born citizen.” “Both confirm that the original meaning of the phrase ‘natural born Citizen’ includes persons born abroad who are citizens from birth based on the citizenship of a parent,” they wrote. They concluded someone like Cruz had “no need to go through naturalization proceedings,” making him eligible. Cruz is still weighing a presidential run.

Why was Obama given so much flack about this very thing? His mother was natural born as well. I'm not really understanding this. IMO, He wasn't born here naturally, he should not be allowed to run. Where his mom was born really shouldn't count. Where he was should.

Obama wasn't given flack for being factually born in another country. Obama was given flack because of the false claim that he was born in Kenya. Please don't try and confound the issues. I'll say this, it'll be great going through all of those "Obama is a Kenyan" threads. It'll be better finding the hypocrites who claimed that being born to an American parent in Hawaii didn't make a citizen. I wonder what they'll say now. ;)

Eligible and viable are 2 different things.
 
I would agree Cruz is eligible to run for president since his mother was a US citizen, regardless of where he was born. I still won't vote for him, of course. But h e's eligible to run.

I never understood the crap Obama got - he was born of a US citizen in a US state. McCain, there could have been some question, but personally I never thought he was ineligible to run.

Still, those who complained about Pres. Obama now have the chance to show their "fairness" and to complain about Cruz.

I would agree Cruz is eligible to run for president since his mother was a US citizen, regardless of where he was born.
That isn't what the Constitution says. The Constitution requires one be a Naturally born citizen.
That phase has a specific meaning requiring birth to a citizen parent, on US soil, and not being born owing allegiance to another country.
That meaning hasn't changed.

Unfortunately the Supreme Court has never heard the issue so folks like Obama and possibly Cruz can get away with it.

I'm not trying to confound the issue. I just find it funny that Obama was given so much grief about where he was born, when his mother was a citizen. It seems that apparently it never would had mattered had he born in Kenya. Despite what the lawyers are claiming, I still believe on should be American born.

Let him run... he has no shot a winning, so he will spend tons of money and provide comic relief during the campaign. He does a great Dr. Suess.

The law is clear: one has to be born within US territory to be eligible for POTUS. Anyway I doubt Cruz would win if he ran so its a moot point.

Travelling in the modern world isn't like travelling in the 1780s. Today, one could be born during a weeklong trip and never be out of the country again. I think that if one is born a citizen, that should be enough. The intention of ensuring that the president is indicative of American culture and values and doesn't have allegiance to another country is valid, but requiring someone to physically be born in the United States (does that include territories?) is not necessary to achieve that intent. I see no reason to bar Cruz from running. I see even less reason to take him seriously as a candidate, however, and every reason not to vote for him.

It will be telling if those that claim Obama isn't a citizen will buy this about Cruz. I expect they will. However it will once again expose them as racists since whether born in Kenya or Hawaii, Obama's mother was surely an American citizen.

Because Obama is black. That is the irony of this whole thing....the tea baggers have no problem with Cruz because he is a white guy. What complete hypocrites they are.

Obama is not the offspring of citizen parents and he was born owing allegiance to a foreign government.
Had you been paying attention you would have also noticed I said that the issue has never been addressed by the Supreme Court.

Hawaii is not a foreign government which is where Barack Obama was born. Neither is Kansas, which is where Obama's mother is from.

Good example of my point. Obama, an unqualified rank amateur wins. But Ted Cruz, a brilliant lawyer who is a magnitude of intelligence above Obama, you consider to have no chance. Cruz supports the Constitution, Obama does not. And that's the problem, we elected the idiot.
