White House calls illegal immigrants ‘Americans-in-waiting’

yes they can have their status changed, but they must seek to do that.......if they do not they are illegal aliens.

It looks like you're basing your belief on the premise that those who are here on such visas aren't aware of what their responsibilities and opportunities are, as if they're here with no knowledge and no guidance of the immigration process.

Here's a clue: the overwhelming majority of them DO know what they can and can't do, and the immigrant community of which they are a part helps guide them and encourages them to do what's necessary to get their permanent residency. I'm very close to the local immigrant community - I used to work for Immigration for a time, and my closest friend (outside my family) was a District Adjudicating Officer for Immigration...

...so in other words, what I'm telling you is that the overwhelming majority of those who are here on H-1B visas do NOT ever become illegal immigrants (because they know that if they ever do so, then once they are caught, then they'd never be able to get such a visa again).

Okay? When you become truly close to the immigrant community, when you have a deep understanding of their cultures, their motives, and their goals, come back and let me know.

what did you just read from me?.......if they don't "seek to do that"....Meaning working to change the status..if they do not......they are illegal aliens.
 
H1B visas are dual intent, allowing for simultaneous application for green card status

No, they are not. Their SPOUSES apply for green cards that allow them temporary legal residence. The whole intent of H1B visas is to have them employed here temporarily.
 
And what happens is when they come here and want to stay in America, they apply for an adjustment of status in order to become legal permanent residents. This is not unusual - in fact, it's quite normal.

And that is contrary to the spirit and the letter of the law concerning H1Bs. They are NOT to import workers, but to fill a TEMPORARY hole.

Perhaps, but he's hasn't been a party follower, or leader since he used them to get elected the first time. He's consistently thrown them to the wolves whenever it's convenient for him to do so.

Which is total bull****. The reason they rarely become illegal aliens is due entirely to their employer's reporting responsibilities. Step outside the lines and Intel will ensure you're on an airplane home most riki tik. However, it's the SPOUSES that tag along who become illegal.

H1B visa holders are NOT immigrants. They are highly skilled GUEST workers. There is no path to citizenship for them. They still have to apply for citizenship (if they wish it) like every other potential immigrant. The ONLY reason that visa exists is that we supposedly can't fill the job slots with our own highly skilled workers. In fact, the hiring company must attest they cannot find native labor and they need the foreign labor before any visa is issued.
