MONTGOMERY, Ala. — A federal court Friday struck down Alabama's ban on same-sex marriage, saying it violated gay and lesbian couples' equal protection and due process rights. In a 10-page decision, Callie V.S. Granade, a district judge for the U.S. Southern District of Alabama, wrote that the state had failed to prove any "rational, much less compelling" link between prohibiting same-sex marriage and having more children raised in "the biological family structure the state wishes to promote." "The Attorney General does not explain how allowing or recognizing same-sex marriage between two consenting adults will prevent heterosexual parents or other biological kin from caring for their biological children," wrote Granade.

thats like 38 states depending on if we are counting stayed/partial states or not.
here we are 25+ cases and 45+ judges ruling in favor of EQUAL RIGHTS

this is ANOTHER judge (appointed by Bush) that ruled it unconstitutional and mentioned equal protection, due process, the 14th, marriage is fundamental right, and loving vs Virginia etc etc

such a huge conspiracy, all this rouge activist judges LMAO

The good news is people still making a mess of this issue today will end up in the history books next to racists of the 50s and 60s. And probably spoken about in similar context.

to be honest im not really worried about SCOTUS at all . . . .
I mean of course "anything" is possible but unless its one of those super weird narrow rullings where they punt and delay (until after the circuit cases) they arent going to rule in anyway except FOR equal rights

i asked the question before and havent gotten anythign back on it and I cant find anything myself but in all of history how many lower courts (total) has SCOTUS gone against?

Meaning at this time if they didnt rule in favor of equal rights it would go against 25+ rulings and 45+ judges, and my numbers are probably rounding down, has that been done before? how likely is it?

thats EXACTLY what is happening. Those idiots are viewed just the same as the racists that didnt want to serve blacks or people that didnt want to employee women etc etc. They are no more than bigots that dont want to respect equal rights of others.

theres two things on thier side, people cant break the law and practice illegal discrimaintion and money talks, if bigots choose to be criminals and close down thier shops somebody else will open up and take that money. :)

well many GOPers support equal rights but unfortunately "stereo typically" they are against equal rights.

I think it could go either way for one simple reason . . . . bigoted extremist squeaky wheels . . .

unfortunately those types of people get the most media attention, so if it goes away theres a chance that it becomes a non-issue cause it is settled BUT bigots and extremists could always continue to cry and continue to want to know the views of GOP candidates . . and if they come out against equal rights that will hurt them

Imagine an overhead pic of 200 alabama/mississippians thrown together, and your goal is to locate the slack jawed yokel with a hat that doesn't have confederate flag. This task will put "where's waldo" to shame

Pretty much the reasons for it that many here have said the decisions would be based on. Equal protection and due process.

i've never said it's any different, with exception of a few small cities. I've never been anything but critical of michigan, and there's a nauseating number of confederate flag hillbillies here too

The thing to keep in mind is sociologically we are at another pivot point. It is not really about my opinion but an obersavtion of how this issue has played out. In a relatively short amount of time we have seen State by State fall in their protections of keeping a marriage about a man and a woman, for whatever reason. 10 years ago this issue was just starting to challenge more of the States. And within the past 20 years you had a Democratic president sign the Defense of Marriage Act (but it should be noted the veto proof Republican Congress that brought this up.) All throughout we have filled the courts with challenges and started to see a change in public support, with a few surprises along the way. Like the California vote on the matter. But all that said, the tide is changing well enough and I suspect when history looks back it will not be too kind to those who stood in opposition to what we are seeing. With plenty of parallels drawn to what the civil rights movement faced 60+ years ago. The pictures of the various opposition will be next to each other, and I suspect the comparison will be harsh.
