    Good question .
The better question is on what grounds were they first detained?
If charges can not be brought, why were they incarcerated?
    Suspicion?

What planet are you on man.
All valid questions except for the second third and last one.
Would you rather the President hadn't bombed anyone?
It sounds like maybe you do.

The United States does not need to declare war in order to take prisoners, nor does any other country as far as I know.

The last 'declared war' by the USA was in WWII. And really, does anyone really care (apart from goofy leftists) what the Islamists think?

    Suspicion?
Suspicion is fine. Why not? Do you understand what war really is?

I don't care what Islamists think , but we all should care what is in our own Constitution.

How long can anyone be held on suspicion? Ever heard of Habeas Corpus? It's kind of an important founding principal of who we are.

Again without a declared war there can be no prisoners of war.
That is why they are called" detainees", not POWs.

Well, we didn't start it, so it's not up to us.

Considering 1 in 3 of these people end up back on the battle, yep.
