Nadia Savchenko: The most controversial prisoner of the war in Ukraine

A shackled Lieutenant Nadia Savchenko being interrogated by rebels in eastern Ukraine.

Somewhere behind the walls of Moscow’s pre-trial detention centre No 6, the Ukrainian MP and helicopter pilot, is slowly starving after 30 days of living on just water and tea. Sunday marks the 30th day of living on just water and tea for Nadia Savchenko, a helicopter pilot who fought in the Iraq war and newly minted Ukrainian MP. She is on hunger strike in protest at what she says are fabricated charges of war crimes brought against her by Russian investigators. She has become the most controversial prisoner of the war in Ukraine, with Vladimir Putin clashing with Barack Obama and Angela Merkel over her fate.

She was captured on the battlefield in eastern Ukraine in uniform and armed. She was interrogated on video by rebels as a POW (picture above) i.e. name, rank, unit, unit location, unit strength etc. Three weeks later she was illegally transferred to Russia and charged with the battlefield deaths of two Russian journalists. Her Moscow lawyer says mobile phone records prove she was not in the area when the journalists perished from a mortar round. Russia denies she is legally a Prisoner of War, yet the Geneva Conventions are quite clear...

Article 4

A. Prisoners of war, in the sense of the present Convention, are persons belonging to one of the following categories, who have fallen into the power of the enemy:

1. Members of the armed forces of a Party to the conflict as well as members of militias or volunteer corps forming part of such armed forces.

If Russia believes POW Lieutenant Savchenko committed a war crime, she should be transferred to the International War Crimes Tribunal in the Hague along with all prosecution documentation and evidence.

Not tried as a civilian in a Putin kangaroo court in Moscow.

A global Twitter-Storm on behalf of Nadia is planned for 26 January 2015 @ 10am

Russia opens fresh case against Ukrainian pilot - lawyers

January 30,2015

MOSCOW (Reuters) - Nadezhda Savchenko, a Ukrainian army pilot under arrest in Moscow, said through her lawyers on Friday that Russia had opened a fresh case against her alleging that she had illegally crossed the border from Ukraine. On Friday, defence lawyer Mark Feigin tweeted what he said was a handwritten note that Savchenko passed on to her defence team during a meeting, in which she says she has been informed of the fresh probe. The new charges carry a term of maximum six years in jail.

On Thursday, Savchenko was transported from one Moscow jail to the medical ward of another, Matrosskaya Tishina ("Sailor's Silence"), because of weight loss, the lawyers said. Mikhail Khodorkovsky, a former oligarch who fell out with President Vladimir Putin, was once held in Matrosskaya Tishina. Sergei Magnitsky, a lawyer who revealed official corruption, died there in 2009. Human rights groups say he was denied proper medical treatment and beaten to death. Putin has dismissed allegations of torture or foul play and said last year that Magnitsky died of heart failure.

Now held in the same prison where whistle-blower lawyer Sergei Magnitsky was beaten to death in 2009 which resulted in the US passing the Magnitsky Act of 2012.
