Mother of German MH17 crash victim sues Ukraine in EU court

BERLIN (Reuters) - The mother of a German woman killed when MalaysiaAirlines flight MH17 was downed over eastern Ukraine in July is suing theUkrainian authorities at the European Court of Human Rights for failing toclose their airspace, a German paper reported.

The mother of the victim named as "Olga L." was seeking $1million in compensation from Kiev for manslaughter by negligence and had begunproceedings in the past week, Bild am Sonntag newspaper said on Sunday.

Will the court force the Kiev authorities to release the ATC data they confiscated the day it happened?

Will Malaysian Airlines find out just who it was that changed the routing initially received by the flight?

Or will secrecy and national security be invoked to keep a false story alive?

I cannot imagine having to land one of those things, but I guess a few did. That picture was taken at Lakeland FL at the public mini-museum there.

Dutch government refuses to reveal ‘secret deal’ into MH17 crash probe

The Dutch government has refused to reveal details of a secret pact between members of the Joint Investigation Team examining the downed Flight MH17. If the participants, including Ukraine, don’t want information to be released, it will be kept secret.

The respected Dutch publication Elsevier made a request to the Dutch Ministry of Security and Justice under the Freedom of Information Act to disclose the Joint Investigation Team (JIT) agreement, along with 16 other documents. The JIT consists of four countries – the Netherlands, Belgium, Australia and Ukraine – who are carrying out an investigation into the MH17 disaster, but not Malaysia. Malaysian Airlines, who operated the flight, has been criticized for flying through a war zone.

Part of the agreement between the four countries and the Dutch Public Prosecution Service, ensures that all these parties have the right to secrecy. This means that if any of the countries involved believe that some of the evidence may be damaging to them, they have the right to keep this secret.

“Of course [it is] an incredible situation: how can Ukraine, one of the two suspected parties, ever be offered such an agreement?” Dutch citizen Jan Fluitketel wrote in the newspaper Malaysia Today.

Joint Investigation Team Includes, Excludes Surprising Members

With the Dutch leading the investigation, the logic being that the flight originated from the Netherlands and the majority of the passengers were Dutch, it has formed a Joint Investigation Team (JIT). At the onset of its creation it seemed obvious that Malaysia would too be included, considering it lost the second largest number of citizens to the disaster and the plane itself was registered in Malaysia. Instead, JIT would end up comprised of Belgium, Ukraine, and Australia, specifically excluding Malaysia.

Malaysia was both surprised and has protested its exclusion from JIT, and has repeatedly expressed a desire to be included directly in the investigation.
