Arkansas, Mississippi overturn gay marriage bans

In Arkansas, U.S. District Judge Kristine Baker ruled in favor of two same-sex couples who had challenged the amendment. They argued the ban violated the U.S. Constitution and discriminated based on sexual orientation."The fact that Amendment 83 was adopted by referendum does not immunize it from federal constitutional scrutiny," Baker wrote in her ruling. The state's marriage laws and the amendment violate the U.S. Constitution by "precluding same-sex couples from exercising their fundamental right to marry in Arkansas, by not recognizing valid same-sex marriages from other states, and by discriminating on the basis of gender," Baker wrote.

U.S. District Judge Carlton Reeves wrote in his ruling, "The Fourteenth Amendment operates to remove the blinders of inequality from our eyes. Though we cherish our traditional values, they must give way to constitutional wisdom. Mississippi's traditional beliefs about gay and lesbian citizens led it to defy that wisdom by taking away fundamental rights owed to every citizen. It is time to restore those rights.""Today's decision may cause uneasiness and concern about the change it will bring," he wrote. "But "'(t)hings change, people change, times change, and Mississippi changes, too.' The man who said these words, Ross R. Barnett, Jr., knew firsthand their truth."

well i agree if that crowd are the ones that are actively trying to stop equal rights. Nobody who is honest respects them or takes them seriously.

It won't be over until it's taken to SCOTUS and they're finally forced to rule on this. It'll be nice to finally see SCOTUS put this nonstop argument away. It'll be great to hear that religion doesn't have a monopoly on the word marriage.

Agreed, that is true now that thier is a circuit break, before that though it would have been possible to not go to SCOTUS but id prefer to anyway just because there will be less crying and strawmen argued over the victory of equal rights :)

That is a queer thing to say in reaction to a gay crowing victory of equality of the inequal. But if you meant that it is pointless to hope for rationality in this question, you are quite right.

You are right that it is certainly a gay old mob that wants to act as though gay matrimony were the same as matrimony of two sexes. But the gout de jour is irrational and so we will act as though they were the same.

oh. I am all for equal rights. But I find people odd that cannot tell the differences. That makes for bad laws and queer outcomes like with some of the equal rights legislation for women some of which has lead to lower wages and poorer advancement for them, which again has to be compensated by further legislation that becomes increasingly unfair. But there are a lot of you guys out there and it is too late to hope that they will learn that differences remain even when you make believe they are not there.

I will just mention your faulty assumption that equal rights legislation for women does not bear negatively on their position in the labor market. It is so bad, in fact, that we had a board level discussion as to whether I could employ further women or advance them. The final desicion was not in the protocol, but they were too expensive and risky for legal reasons in comparison to men. It was preferable to use men for equal rights reasons.

3.) Being one of my responsibilities is hiring and recruiting this easily one of the most inane and funniest things thing i have ever read, and anybody and everybody who thought that has no place in the workforce. Its completely illogical lol

That is why matrimony worked so well as a social tool. If you set it up, so that they slept in one bed, there was reproduction. If they had to stay together, that gave the kids security of upbringing. As easy as that.

Of course, technology has progressed, so that the social instrument no longer works as well as it did. So it would probably be a good idea to drop it altogether. Dis-involving the state in this would seem a good idea. That would put a now mostly useless public good into the private sector, where it belongs.

since the 14 is about equal rights/protection in relationship to LAWS what facts do you base your claim on?

what do you have that goes against many of the approx 50 judges/ around 35 cases that have ruled this way and referenced the 14 and equal rights that says they all got it wrong. Id love to read it. Thanks

What is the 14th amendment related to? And what exactly is your problem with equal protection under the law, other than your disapproval of homosexuality?

The ONLY purpose of the 14th amendment was to ensure that black Americans would have the same rights across the former Confederate states as they had in the rest of the nation.

Which was why the 14th was passed in conjunction with the 13th & 15th amendments.
 
It's good to see gays having rights there with marriage, but it's also sad that many will believe a legal recognition makes a homosexual "marriage" a true marriage or even something good for the individuals. I pray that they may all repent and leave their lives of sin.

and can you explain why it has be referenced in 1000s of cases that doesnt have to do with blacks?

So sick of hearing about this. It isn't even news anymore. I wish every state would just overturn it, stop acting like their state is somehow going to be different and keep their SSM ban, and move this crap along.
