    U.S. justice temporarily blocks gay marriage in Kansas



    WASHINGTON (Reuters) - A U.S. Supreme justice on Monday temporarily blocked gay marriage in Kansas a day before it was due to go into effect.
    Justice Sonia Sotomayor issued an order saying that the court wanted gay marriage advocates to respond to the state’s application seeking to put gay marriage on hold. U.S. District Court Judge Daniel Crabtree struck down the state’s gay marriage ban last week, ruling that it would go into effect on Tuesday at 6 p.m. Eastern Time (2300 GMT) if no other court intervened.

    Kansas wants to appeal. They applied to the appeals court for a stay and where denied, so they are bumping that application to SCOTUS. Sotomayor granted the stay to give Kansas time to put their application together and get it resolved. It is pretty much the logical, sensible move.

    Gracias for the explanation. Now it makes sense. I didn't realize someone was looking to appeal (although I should have figured as much).

    The interesting interim question is whether SCOTUS in whole will grant the full stay request Kansas is requesting. I kinda suspect they might since with the recent Michigan case, there is now reason for SCOTUS to actually take up an appeal of SSM and rule on SSM bans once and for all. SInce they are likely to do that, it might make sense to grant full stays until they have a chance to rule, to avoid situations where it was illegal, then legal and people got married, then illegal again potentially.

    Agreed. And it mesmerizes me that the SCOTUS has not taken up this issue once and for all, and make an across the board ruling.

    Don't get your hopes up old man.....this battle is over. This is just a common SCOTUS procedural move. If you followed the Court at all you would have realized that.

    Standard procedure to put a stay pending possible appeal. They've granted the stays essentially every time they were asked for.

    Edit: Until the SCOTUS rejection of hearing the case we had recently, anyway.

    The temporary stay was just struck down by the entire Supreme Court (save two justices, Scalia and Thomas)
