    Makes sense, although there was some possibility that a stay would have been granted now that it looks like SCOTUS will have to take the case after all, as Redress pointed out.

    Courts do not, routinely, issue stays of lower court rulings unless a) the upper court will take up the appeal and b) there is a strong likelihood that the appeal will be granted.

    To me, the initial move was to give opportunity to the entire court to have a say and the subsequent denial of the stay says to me that the appeal will likely be summarily denied and not heard by the Supreme Court. But that's just an educated guess.

    Justice Sonia Sotomayor issued an order saying that the court wanted gay marriage advocates to respond to the state’s application seeking to put gay marriage on hold. U.S. District Court Judge Daniel Crabtree struck down the state’s gay marriage ban last week, ruling that it would go into effect on Tuesday at 6 p.m. Eastern Time (2300 GMT) if no other court intervened.

    This thread totally confused me more than usual. I was certain that the Court allowed Kansas to go forward with SSM.

    It did. There was just a very brief procedural stay, because there was a theoretical possibility that SCOTUS might issue a full stay pending appeal. SCOTUS almost immediately replied with "NOPE," so things moved forward on schedule.
