There was no threat.
Only stupid people would claim otherwise.
Hard to justify?
Depends on the incident.
In this case, on how the information was presented and argued to the Jury.
The person threatened to kill him was perceived to have the means and apparently was acting on the threat by getting out of the vehicle to carry through with the threat.
The threat had been established, and even though that threat ducked for cover, it was still present in the vehicle while the shots were fired.
Nor was there any way he could have seen if they were preparing to return fire or not. Continuing to fire until the threat ceases to be a threat is logical and normal.
And that only happened after the vehicle with the threat still inside got far enough away.
There was no threat.
