Gov. Jerry Brown announced Sunday that he has signed a bill that makes California the first in the nation to define when "yes means yes" and adopt requirements for colleges to follow when investigating sexual assault reports.
State lawmakers last month approved SB967 by Sen. Kevin de Leon, D-Los Angeles, as states and universities across the U.S. are under pressure to change how they handle rape allegations. Campus sexual assault victims and women's advocacy groups delivered petitions to Brown's office on Sept. 16 urging him to sign the bill.
De Leon has said the legislation will begin a paradigm shift in how college campuses in California prevent and investigate sexual assaults. Rather than using the refrain "no means no," the definition of consent under the bill requires "an affirmative, conscious and voluntary agreement to engage in sexual activity."

I just wonder how they are going to make it work. I mean, how two people are going to express or confirm their mutual consent before sex? Cause all these nods and movements are not solid especially when you are drunk. You need something more trustworthy, something that would prove you were serious – the next morning.

From what I read, the main problem are not the existing laws, but the fact that authorities ignored cases of sexual assault and didnt take victims serious.

So this is just what my German-English dictonary translates as "tokenisitik".

It serves no purpose other than attempting to create the illusion that something is done about the problem.

Whilest the real cause of the problem is ignored.

This is a bad law with too many loopholes and too floppy of definitions. Kids are dumb and will do dumb things that will allow this law to be taken advantage of.

And now we'll turn drunken one night stands into rape. You think this isn't going to call in fights with high priced lawyers over the definition of "consent"? Nonverbal consent such as a nod....really? You see no problems stemming from this terribly written law full of floppy definitions? This is nothing more than knee jerk reactionary legislation that will come back to bite us.
 
Another way to make grey what is essentially a he-said-she-said. The consequence of the former law was that it was difficult to convict guilty people. The consequence of the new law is that it appears easier to convict the innocent. Personally, I think convicting the innocent a graver offense than releasing the guilty. But perhaps that's just me.
 
The new slogan is yes means yes, bc "no means no" did not prevent rapes. I hope they didn't waste money on this!

Are you suggesting that you don't know if the person you are having sex with has actually consented to have sex with you?

Because if you don't, the law isn't your only serious problem.

It seems to deal only with college students. I wonder why? Is there no confusion among other late teens and early 20 kids about whether sex is consentual or not?

So Californians can't legally consent to sex when they're drunk? Yes means yes except when yes means no?

So the legislature does not have the power to legislate without enforcing compliance through the withholding of state funds for student assistance?
In relation to organisations internal policies and disciplinary procedures I suspect that is the case (Constitution at all). Remember this is quite distinct and separate from any formal legal proceedings but is about how the educational institutions deal with students who have been accused of sexual assault or rape.

It could be argued that the fact colleges seem to have developed such powerful pseudo-judicial systems that operate independently (sometimes counter to) true legal proceedings is really the core of the problem here.

It shouldn't be a university's job to police sexual assault on campus anyway. That's what we have police for.

I don't know the answer and I've never been to California and I don't know what's wrong with those people so why is a law like this even necessary?
