    In relation to organisations internal policies and disciplinary procedures I suspect that is the case (Constitution at all). Remember this is quite distinct and separate from any formal legal proceedings but is about how the educational institutions deal with students who have been accused of sexual assault or rape.

    It could be argued that the fact colleges seem to have developed such powerful pseudo-judicial systems that operate independently (sometimes counter to) true legal proceedings is really the core of the problem here.

    This law is pointless and will do nothing. There's still going to be just as much drinking and sexual activity, which will mean just as many sexual assaults (or claimed sexual assaults). And unless there are witnesses (which is rare), it's still going to be he said/she said.

    It shouldn't be a university's job to police sexual assault on campus anyway. That's what we have police for.

    I don't know the answer and I've never been to California and I don't know what's wrong with those people so why is a law like this even necessary?

    Under the bill, someone who is drunk, drugged, unconscious or asleep cannot grant consent.
    Nope, someone who is drunk cannot give consent, so it would be considered rape. And we know that drunk college kids are oh so going to be the model of restraint and intelligence.

    And when both participants are drunk (a likely scenario), are we to assume that only men should be held responsible for their decisions? Or if neither is able to give consent, do the penalties simply offset?

    I myself was wondering if this were going to go the other way too. What if the dude is drunk and the chick is sober...rape? Dude can't consent.

    I'm not sure where this is going to end up, but it's going to be a mess.

    Only if you want to believe what some journalist says and ignore that the law doesn't say someone who has been drinking is not capable of giving consent.
