    I also know via work that certain levels of marijuana and THC are acceptable depending on the employer. Some employers accept a range depending on the job, while others don't allow any evidence of it in jobs where there is machinery or requires handling a lot of money.

    New York is a comparative negligence state, they will decide the negligence factor of both parties before a civil suit. If a judge views Ward as having been negligent by having gotten out of the car and by having marijuana in his system it will greatly impact a settlement amount and he could decide to not allow a civil suit. It might be hard for the Ward family to sue Stewart at all.

    I dont think that would matter since it would have been a criminal charge. And you're not protected from crimes.

    However if there is a civil suit filed by the family, that might make a difference. Dont know.
