‘I just kept asking: Why am I being arrested for sitting in my aunt’s driveway?’

You are seriously denying property rights? Wanna know how that holds up to the 5th amendment? For the "conservative" you are, you are quite the ****ty conservative? Or is that just cuz they are black?
No. What I am saying is that you have failed to support your argument.
It is like you do not even understand that a State Of Emergency was declared.
:doh

So again, let me help you out with the general meaning and understanding of Curfew.

cur·few
ˈkərˌfyo͞o/
noun
noun: curfew; plural noun: curfews

a regulation requiring people to remain indoors between specified hours, typically at night.
"a dusk-to-dawn curfew"
the hour designated as the beginning of a curfew.
"to be out after curfew without permission was to risk punishment"
a daily signal indicating the start of curfew.

No. Because private property is not public property.

Citation please. According to you, by your logic here, a gang of 50 people could be gathered in my front yard and not risk a curfew violation. I seriously doubt that, TDS. I think you'll find that curfew means everybody's supposed to be indoors.

Oh wait so you want to forget the 5th amendment because they told you so! Gotcha!!!!

Citation? You need a citation between private and public property? Who woulda thought the stereotypical socialist would have to defend this point..

No, TDS. I need a citation that shows that somehow being outside on private property exempts one from curfew.

That would mean thousands could gather in a WalMart parking lot. Think about it. And then admit you're wrong. Do stereotypical socialists do that??

Stop with the nonsense.
Everyone knows what a curfew is.
If you don't, that is your problem.

Being in a motor vehicle in a driveway is not being inside and it shows intent to break the curfew.

So stop with the silliness.
They were in the wrong and were arrested because they were.

You think they have a 5th Amendment claim, write them and tell them. Their lawyer will laugh at your letter.

‘I just kept asking: Why am I being arrested for sitting in my aunt’s driveway?’ - The Washington Post

Wait.. So I thought the media was trying to portray the 7 arrested as rowdy. (not said directly but it sure seemed that way)

Turns out 5 of the people arrested that night were smoking in a car on private property??? Ummmm. If this is true then all the leadership in this police force needs to be stripped and re-established by the community. This is really starting to sound like some NAZI crap. Are the police trying to inflame the local populace on purpose or something? Who the **** pulls a gun out on someone for sitting in a car? Is curfew enough to aim a deadly weapon at someone??

Well I guess they were wrong...

Hampton, who owns a T-shirt-printing business, says they discussed just standing in the yard but worried it might look as if they were loitering passersby. So the trio went to his car to smoke, figuring that a private car on a private lawn would not fall under the curfew.

Curious as to why they just didn't go INSIDE the aunts house?

Was it because they weren't invited and she didn't know they were there - perhaps?

For all the cop knew they were driving around - and pulled off the street into some RANDOM person's driveway.

If they're complaining that things are STRINGENT then they need to wake the **** up - it's for a good reason - and playing the 'gee, uh, I didn't know I couldn't just sit in a random car in a random driveway - durh' routine doesn't excuse you.

“They said, ‘Curfew’ — and I said, ‘But I’m sitting at my aunt’s house.’ ”

So?
CURFEW for a ****ing city is serious goddamned business. Sorry - but I don't see 'it's okay to sit in the driveway of a house' in the exemptions list.

All I see are people who know there was serious **** at hand - and claimed ignorance as a means of bending the rules a bit. More like children would do when their parents lay down some serious rules because they're grounded and kid comes as close to bending the rule as possible without breaking it - just to test the boundaries.

And that's all I see here.

If the march ended at midnight - then why were they even going anywhere at 2am?

Now if they were parents driving a child to the ER or something I'd have a different response, here. But they weren't - so I don't.

If everyone - including Brown - simply respected THE LAWS and respected OTHER PEOPLE none of this entire cluster**** situation would even be happening. Brown would still be alive, and Ferguson wouldn't be devolving into a 3rd world country.

You keep throwing out this "intent" crap. Thats like saying a drunk who passes out in their car on purpose intended on driving drunk... They didnt. They intended on sleeping. This guy intended on smoking a cigarette privately, separated from the public. The guy was at protests earlier. HE LEFT. He obeyed the curfew. His intent was obviously NOT to challenge the curfew.

Riiiight.

If my TOWN was under a CURFEW because some freaking morons were doing nothing but causing SERIOUS trouble day in and day out I wouldn't be outside at 2am smoking a ****ing cigarette only to complain when they caught me.

You know - because I'm not stupid.

:doh
He was arrested for violating the law.
Being in a driveway in a vehicle is not complying with curfew. So stop the nonsense.
And as for intent? Bs. He wasn't fully complying and you do not know his true intent.

Again:
The point being, in this case, the curfew kept the thugs/criminals off the streets and from committing property damage and looting.
So despite your dislike of it, the curfew worked during those hours.

Well nothing happened, did it?

“Last night’s curfew — I think everybody worked well,” Nixon said on CNN’s “State of the Union.” “We’re always disappointed when things aren’t perfect. But thousands of people spoke last night, thousands of people marched, and [there was] not a single gunshot fired by a member of law enforcement last night.”
State officials defend Ferguson actions as Justice Department orders new autopsy - The Washington Post

Do you realize the video right at the top of the page is about people defying the curfew? Do you enjoy making your opponents arguments.

Well if they didnt have permission they would be trespassing and violating curfew. Also 50+ people might start to fall into whatever gets people in trouble for throwing parties.

I assume the aunt doesnt allow smoking in the house? Or maybe they wanted to listen to music in the car and it was late at night? Really its none of your business, or the cops. If they would have been on the street then the cops would have an argument.

ANd pAy attention to what was already provided.

Where was the looting and property damage that the curfew was put in place to prevent?

Where?

Ah - but it is the cop's business.

See?

That's the point of having a CURFEW.

If people claim not to understand that then they're being intentionally obtuse about all of this - and it's a shameful embarrassment that we live in a country where so many adults are incapable of thinking beyond their selves.

Are you people literally telling me that there is no such thing as private property rights when someone in government says so? So no one has property rights here?

Doesn't know what a curfew is, but thinks some of Hamas is not terrorist, Iran is a democracy and the US lacks human rights.

Look at that conclusion. Just look at it.

Wow, man.

Are you people literally telling me that there is no such thing as private property rights when someone in government says so? So no one has property rights here?
Rights can be suspended. States of Emergency, Martial law.

But the thing here is, you have failed to make any legal argument. None!
You have provided nothing to back up your assertions.
And their violation, is not about property rights at all.

So you still have nothing.

But, Excon...

If rights are not absolute, then we're the same as North Korea!

That point is moot because people PURPOSELY violated the curfew in protest and the cops used crowd control on them, yet didn't arrest them. Yet they arrest people on private property. They are testing how far they can push the rights boundary with this crap... or something.

Is the backyard ok? Can someone be in a backyard or is that still considered "outside" breaking curfew? Curfew has always pertained to wandering around in public. I dunno why you are changing the spirit of it. At least in America that is what it has always pertained to.

But for calculations; There are absolutely no absolutes.

It better be absolutely absolutish absolutism or it is downright hypocrisy and the same thing as terrorism!!11!!
