It depends on the circumstances though. A fenced in swimming pool behind a locked gate, probably not. Likewise, a weapon with a lock on it that is accessed after somebody tracks down a key would probably not constitute criminal negligence.

Inviting the three year old over to play, and then not supervising him or her?- probably negligent. Not fencing the pool, or not locking the gate?- maybe.
