In ‘sexting’ case Manassas City police want to photograph teen in sexually explicit manner, lawyers say - The Washington Post

A Manassas City teenager accused of “sexting” a video to his girlfriend is now facing a search warrant in which Manassas City police and Prince William County prosecutors want to take a photo of his erect penis, possibly forcing the teen to become erect by taking him to a hospital and giving him an injection, the teen’s lawyers said. A Prince William County judge allowed the 17-year-old to leave the area without the warrant being served or the pictures being taken — yet.

Foster said the case began when the teen’s 15-year-old girlfriend sent photos of herself to the 17-year-old, who in turn sent her the video in question. The girl has not been charged, and her mother filed a complaint about the boy’s video, Foster said.

Borderline NSFW, and definitely not safe for your blood pressure. I have no words for this. How is what the Manassas, Virginia police department doing legally justifiable? And how is what the 17-year-old did worthy of sex offender registry, especially since his g/f sexted him first? Because she's 15? Really? Obvious police state is obvious.

This is a state that had banned homosexuals from having sex up until 2003. Does this really surprise you?

OMFG that is just so wrong on so many levels. And I so agree with your point about the sex offender registry. He's a 17 year old kid. He didn't rape anyone. He didn't molest a 4 year old. FFS.

This country must be going mad if this story makes sense to anyone.

These are teenagers playing doctor, electronically. What the prosecution wants to do should be blocked by the judge in this case. The kid is a juvenile and the state wants to take pictures of his erect penis, not because he raped someone, but because he sent an alleged video of himself to a 15 year old girl (also a minor) and the police need a valid penis identification.:3oops:

Yes, we are getting very authoritarian and not just with the police but this is trickling down from our government in many ways. That we ALLOW such a thing to happen ... well.... I guess we deserve everything we get.

If this were a capitol case I'd say go for it. But here the charge does not rise to that level. Really, they should be able to prove he sent it without this, or drop it and keep an eye out, the kid will sink himself soon enough. Of course the parents of both are now aware which may resolve the situation by itself.

Huh??

The prosecutor should be charged with criminal solicitation to commit sexual assault and to produce child pornography.

Forcibly and purposely performing a physical act on another person (and taking pictures) in order to sexually arouse them is the same regardless of the means.

(This is also a good argument against gun control).

This is a state that had banned homosexuals from having sex up until 2003. Does this really surprise you?

And now they may have court-ordered sexual assault and child pornography, perhaps they should have retained their sexual morality laws.

This thread could be so much more funny if the word Tallywhacker were used.

It would also be funny if I could find a small image of Eisenhower to include in this post.

It sounds like the Manassas Police want to get into the child pr0n industry.

Sick ****s, says I.

In the context on this statement from the Police Department, I'd be wary in trusting the defence lawyer to give a balanced and honest picture of what has actually happened. Certainly getting all angry and ranting trash about "police states" is totally unjustified (and I'm sure exactly the response the article was designed to generate).

What???? A lawyer playing fast and loose with the truth and the MSM going along with a 'police state' mantra???? What IS this nation coming to????

Course after a few dis-CUSS-ions with self identified lawyer types in here I'd have to agree with you.... :peace

What part of clear English are you having trouble with? There's no need to go there with this case. They can easily prove he sent the text. If they cannot meet that burden, well the kid is stupid and will reoffend and it'll be even easier to prove the second time around.

Now that the parents know, both sets, well I'd suppose he's already receiving some punishment.

Maybe someone can help me with this one - if the boy is getting tried in a juvenile court as a juvenile, I am assuming he is by law being considered a juvenile. So if they are both juveniles in the eye of the law, why is he the only one being charged? Maybe I need more info on the type of picture she sent to him but since he is being charged with possession of child pornography that must mean she sent a pornographic picture of herself, right? So if she manufactured a picture of herself and also possessed the video of him, another juvenile, it's the same thing only he is a male and older, although again still a juvenile. What is the difference between the two and why is he only being charged? According to some Virginia laws I can find, 18 is considered an adult there and the age of consent

What are the consequences of sexting?
The legal consequences of sexting are very serious. It is against the law in Virginia to produce, store or share lewd or explicit pictures of minors (those under 18). Sexting can be prosecuted as child pornography, a felony that can result in years in prison and having your name on the sex offender registry for life.

Again, why isn't she being charged as well??

He sent the pic, she didn't. Also, she was 15, below the state's age of consent. He however was 17 and above the age of consent.

I believe Phys251 was confused by your implication that sexually assaulting people accused of capital crimes could be justified.

Unfortunately I'm not articulate enough to describe how I feel: this case is disgusting in a multitude of ways.

I think everyone should send this police department pictures of their junk.

Do you think he should be punished by the law? What about his girlfriend?
