Supreme Court says public sector union of home care workers can't force nonmembers to pay fees.

WASHINGTON (AP) — The Supreme Court says public sector unions can't collect fees from home health care workers who object to being affiliated with a union.

The justices on Monday said collecting the fees violates the First Amendment rights of workers who are not union members.

The ruling is a financial blow to labor unions that have bolstered their ranks in Illinois and other states by signing up hundreds of thousands of home health care workers.

The case was brought by a group of Illinois in-home care workers who said they didn't want to pay fees related to collective bargaining. They claimed the "fair share fees" violate their constitutional rights by compelling them to associate with the union.

This is a win for constitutional rights but a big setback for unions. It looks like "fair share fees" are, by their very nature, unconstitutional.

Someone should start a thread.

This SCOTUS is really surprising me these days. Excellent ruling.

I don't think the HL decision is in yet.

Yayy! Now they get all the benefits and representation that union offers for their employment but they dont have to pay the dues!

Yea, drudge is reporting HL won.

5-4 decision.

This is a great start to rid our country of union coercion. Countries like Germany and Denmark (among dozens of others) have shown us that you can actually have fully functional unions without coercive membership policies.

If a union has to force someone to pay them, they're not providing enough added value to be worth the money given.

Great news! Thanks for posting it.

California taxpayers pay the SEIU over $60 million in dues each year, collected through the statewide scam of In Home Support Services. Great to see the legislators this evil union purchased years ago won't be allowed the screw the citizens in this state via this method any longer. Or at least one would hope.

Is he usually right on these things when he reports? I do see it on his site now. I can't find anything else yet on the net.

I hope Drudge is right!

That is exactly what will happen. Just another way Republicans can try to not only defund and starve our public services but now also starve unions of any funds. Nothing like a good old fashion oligarchy.

Especially when they work in their home, caring for a loved one.

Freedom and liberty win again!

Fair share fees are still very much legal what was decided was a narrow reversal of the unique example in Illinois.

"The court held on a 5-4 vote that the free speech and free association rights of the workers were violated but the scope of the ruling was limited because the justices decided not to upend a decades-old practice that lets public-sector unions collect money from workers who do not want union representation."

Ah, yes, liberals love forcing their views on others and choosing what's good for them. Freedom is fine as long as you believe as they do.

Neither of you have a clue what the case was about. Do you?

What does forced Union dues have to do with " Public Services "?

Re: Supreme Court says public sector union of home care workers can't force nonmember

Yup, I see it now. I started a thread on it.

GOOD for Hobby Lobby!

Both decisions were 5-4, I think, and Justice Alito wrote both majority opinions.

Re: Supreme Court says public sector union of home care workers can't force nonmember

Some reports are saying this applies to way more than home health care workers. The suggestion is union's can't force people to pay dues? If that's true it'd be a truly GREAT day for our nation.

It specifically doesn't do that.

I think it's safe to say this paves the way for any and all opposition to the practice. It's a good day.

Maybe the unions can market themselves with different dues rates so that someone who doesn't want their funds to go to political campaigns can pay a lower amount in dues and support the union activities they do support.

I think it's safe to say this paves the way for any and all opposition to the practice. It's a good day.

That seems doubtful. If the court wasn't willing to rule so broadly in this case what makes you think they are laying the brickwork to do so five years from now?
